59R-5490 ,.-..- RESOLUTION NO. ~4qO A RESOLUTION OF THE CITY COUNCIL OF THE CrTY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE ~lENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its inten- tion to change the boundaries of the zone or zones hereinafter men- tioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct su~h public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from persons interested therein, and WHEREAS, within a period of forty (40) days following the fina.l hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 15th day of Se~tember , 19 59 , as the time and the Council Chamber in the ity Hall of the""1rrty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing 'lnd did give all persons interested theretn an opportunity to be hea.rd and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said property and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the Ci~y or Anaheim that all or the property and area situated in the City of Anaheim, County of Orange, State of California, described as rollows, to wit: --. Beginning at the center line of South Street, at the South- west corner of Lot 12 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, and running thence on the said center line of South Street, North 74to East 9.175 chains; thence North 15to West 5.45 chains; thence South 74to West 9.175 chains; and thence South 15to East 5.45 chains to the point of beginning. -1= F-58-59-98 be changed from R~, RESIDENTIAL-SUBURBAN ZONE to R-l, SINGLE- FAMILY RESIDENTIAL ZONE, with the exception of the Westerly 150 feet thereof, which is now R-1, SINGLE-FAMILY RESIDENTIAL ZONE, and that said Westerly 150 feet remain R-l. That that portion of subject property which is now R-O, being all of said property except the Westerly 150 feet thereof, shall be changed to R-l, upon the following conditions: 1. That the lot size or area of the tier of lots along South Street shall be limited to a minimum of 8,000 square feet. and that the houses to be constructed on these lots shall contain a minimum livable floor area of 1,500 square feet. 2. That the lot size or area of the tier of lots adjacent to Tract No. 2205 shall be limited to a minimum of 7,200 square feet, and that the houses to be constructed on these lots shall contain a minimum livable floor area of 1,300 square feet. 3. That the lot size or area of the remainder of the lots in subject property shall be limited to 1,200 square feet, and that the houses to be constructed on these lots shall contain a minimum livable floor area of 1,225 square feet. 4. That the owner of subject property place of record standard City of Anaheim R-1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the minimum livable floor area of the houses constructed on the tier of lots along South Street to 1,500 square feet, and the minimnm livable floor area of the houses constructed on the tier of lots adjacent to Tract No. 2205 to 1,300 square feet. 5. That the owner of subject property deed to the City of Anaheim a strip of land 32 feet in width. from the center line of the street, along South Street, for street widening purposes. 6. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks. street grading and paving, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 7. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 8. That the final map of the tract in which subject property is included be recorded. 9. That Conditions Nos. 4, 5, 6(b}, 7 and 8. above mentioned, shall be complied with before an Ordinance reclassifying said property is adopted. -2- BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
