59R-5488 RESOLUTION NO. 5488 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETEIDHNING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AY1ENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREASj the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its inten- tion to change the boundaries of the zone or zones hereinafter men- tioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Codej and did duly hold and conduct sueh public hearing to consider said proposed change of zone or zones9 and did receive evidence and reports from persons interested therein.~ and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and re~sons ror recommending an amendment to said Article IX. Chapter 2 or the Anaheim Municipal Code to effect the proposed changes in the houndaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of th8 City Planning Commission, the City Council did thereupon rix the 15th day of September ,1959, as the time and the Council Chamber in the City Hall or the-mty or Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX. Chapter 2 of the Anaheim Municipal Code; and WHEREAS 9 at the time and place fixed for said public hear= lng, the City Council did duly hold and conduct such public hearing qnd did give all persons interested therein an opportunity to be beard and did receive evidence and reportsj and did thereupon con- sider the recommendations of the City Planning Commissionj and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said property and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. NOW, THEREFOREj BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: The East 10.5 acres of the East half of the Southwest quarter of the Northeast quarter of Section 7, Township 4 South, Range 10 West, S.B.B. & M. =1= F-59-60-15 be changed from R-A. RESIDENTIAL-AGRICULTURAL ZONE to R-1. MULTIPlE- FAMILY RESIDENTlAL ZONE, upon the following conditions: 1. That the owner of subject property place of record standard City of Anaheim R-3 Deed Restrictions, approved by the City Attorney. 2. That the owner of the property deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Crescent Avenue, for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work be com- plied with as required by the City Engineer and in accord- ance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 4. That the owner of the property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 5. That a subdivision or final map of Tract No. 2962 be re- corded.. 6. That the owner of the property pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, which amount shall be paid at the time the building permit is granted. 7. That all of the above conditions, with the exception of Conditions Nos. 3(a) and 6, be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper. 1t)th THE FOREGOI~G RESOLUTION is signed and approved by me this day or Seotember · a29,' 'i;~.
