3995ORDINANCE NO. 3995 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the Planning Commission did adopt its Resolution No. PC 79-47determining that a change or changes in t e zone or zones hereina ter mentioned and described should be made as hereinafter set forth after a duly noticed hearing; and 1411EREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That certain parcel of land in the City of Anaheim, County of Orange, State of California, described as follows: Commencing at the southeasterly corner of Tract No. 8533, also being the southerly ter- minus of the easterly line of Imperial Highway as shown on a map of said tract recorded in Book 393, pages 47 through 49, inclusive of Miscellaneous Maps in the office of the County Recorder of said Orange County; thence along the southerly prolongation of the easterly line of said Imperial Highway south 100 39' 48" west 516.14 feet; thence south 790 20' 12" east 446.55 feet; thence south 30 24' 21" west 378.67 feet to the TRUE POINT OF BEGINNING; thence East 473.99 feet to the northwesterly corner of Lot 26 of Tract No. 9750, said corner also being the northwesterly terminus of that cartain course shown as north 320 22' 0011 west 164.03 feet in the westerly boundary of said tract as shown on -1- ATT Y-2 8 78-79-34 a map recorded in Book 437, pages 28 through 31 of Miscellaneous Maps in the office of County Recorder of said Orange County; thence along said westerly boundary and said course south 320 22' 00" east 164.03 feet to the southeaster- ly boundary of said tract, also beim; a point on that certain course described as "North 690 05' 26" east 1209.96 feet" in the northwesterly line of Parcel 1 of the right-of-way easement of Southern California Edison Company as described in deed recorded December 23, 1968 in Book 8824, page 19 of Official Records; thence along said northwesterly line south 690 05' 46" west 685.69 feet to an angle point in said northwesterly line; thence leaving said northwesterly line north 110 36' 50" east 391.21 feet more or less to the true point of beginninCD g. now is "RS -.A-43,000 (SC)" RESIDENTIAL/AGRICULTURAL (SCENIC CORRIDOR OVERLAY) ZONE and that it be changed to and incorporated in "RS -HS -43,000 (SC)" RESIDENTIAL, SINGLE- FAMILY HILLSIDE (SCENIC CORRIDOR OVERLAY) ZONE, subject to the following conditions: 1. Prior to the issuance of a building permit, the owner(s) of subject property shall either (a) record an easement for ingress and egress purposes to the subject property from a public street, said easement to be submitted to and approved by the City of Anaheim prior to recordation; or (b) post a bond to guarantee the construction of a public street to subject property in accordance with all applicable City standards and specifications, the bond to be in an amount and form satisfactory to the City of Anaheim. 2. That any specimen tree removal shall be subject to the regulations pertaining to tree preservation in the Scenic Corridor Overlay Zone. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made aa part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. -2- SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
