59R-5464 RESOLUTION NOo 5464 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETEm~INING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM ~UNICIPAL CODE SHOULD BE ~iENDED TO ACCOMPLISH SAID CHANGE OF ZONEo WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its inten- tion to change the boundaries of the zone or zones hereinafter men- ~joned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code. and did duly hold and 'conduct su~h public hearing to consider said proposed change of zone or 7.ones. and did receive evidence and reports from persons interested therein~ and WHEREAS. within a period of forty (40) days following the flnal hearing thereon, the Planning Commission did duly announce by formal resobtion its findings of facts and declare its opinions and reRsons for recommending an amendment to said Article IX. Chapter 2 of th~ Anaheim Municipal Code to effect the proposed changes in the h~lndaries of the zone hereinafter mentioned and described; and WHEREAS. upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 1st day of ~tember , 19 59 , as the time and the Counc i 1 Chamber intbe Ci ty Hall of the lITty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX. Chapter 2 of ~he Anaheim Municipal Code; and W"rlEREAS9 at the time and place fixed for said public hear= lng, the City Council did duly hold and conduct such public hearing 'lnd did give all persons interested therein an opportunity to be beard and did receive evidence and reports. and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth9 is more suitable for the zone or zones to which it is proposed to (,hange said property and area and that the inclusion of said property Bod area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in sdjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of' Anaheim that all of the property and area situated in the City of Anaheim. County of Orange. State of California, described as rollows, to wit: The Westerly 193 feet of the Southerly 147.11 feet of the North half of the Northwest quarter of the Southwest quarter of the Northwest quarter of Section 9, Township 4 South, Range 10 West, San Bernardino Base and Meridian. -1- F-59-60-8 be changed from R-A, RESLDENTlAL..AGRlaJLTIJRAL ZONE. to C-I, NEIGHBORHOOD-OOMMERClAL ZONE, upon the following conditions: 1. That the owners ofiSubject property deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Euclid Avenue for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage faci 11 ties, or other pertinent work be complied with as required by the City Engineer and in accordance with stand- ard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted wi ththe City to guarantee theinstalla- tion of said engineering requirements. 3. That the owners of subject property p~ to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 4. That the owners of subject property place of record standard City of Anaheim C-l Deed Restrictions; approved by the City Attorney. 5. That all of the above conditions, with the exception of Condition No.2 (a), be complied with within a period of 90 d~s from date hereof, or such further time as the City Council m~ grant.
