59R-5463 RESOLUTION NO. 5463 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEHj FINDING AI'ill DETERMINING THAT A CHANGE OF ZONE SHOULD NOT BE GRANTED IN A CER- TAIN AREA OF THE CITY HEREINAFTER DESCRIBED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a pUblic hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and 'mIEREAS, within a period of forty (40) days following the hearinG thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for reconill1ending a denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and '1'IHEREAS, upon receipt of the report and recommendation of the City Planning COnilllission, the City Council did thereupon fix the 1st day of September, 1959 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard and did receive evidence and reports and did thereupon consider the reconilllendation of the Ci ty Planning Commission; and ~{HEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone or zones, as herein- after set forth, is more suitable for the zone in which it is now incorporated and that a change of zone should not be granted; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of ,~aheim, County of Orange, State of California, described as follows, to wit: Lots 8, 9, 10 and 11 of Tract No. 7L~3, County of Orange, State of California, as shown on a map thereof recorded in Book 22, Page 10, Miscellaneous Maps, records of said Orange County. remain in the R-A, RESIDENTIAL-AGRICULTURAL ZONE in which it is now incorporated, and that the reclassification to C-l, NEIGHBOR- HOOD-COMMERCIAL ZONE, be denied as recommended by the City Plan- ning Commission. -1- F-59-60-7 THE fOREGOING RESOLUTION is approved and signed by me this 1st day of September, 1959.
