4028ORDINANCE 140. 4028 AN ORDINANCE OF THE CITY Or ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the Planning Commission did adopt its Resolution No. PC 8-2 0 determining that a change or changes in t e zone or zones hereina ter mentioned and described should be made as hereinafter set forth after a duly noticed hearing; and 1,1iEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: The North 348 feet of the West 125.17 feet of the Northeast quarter of the Northeast quarter of the Southwest quarter of Section 28, in Town- ship 4 South, Range 10 West, in the Rancho Las Bolsas, in the City of Anaheim as shown on a map thereof recorded in book 51, page 10, Miscellan- eous Maps, records of said Orange County. The North 256 feet of the East 1 1/2 acres of the Northwest quarter of the Northeast quarter of the Southwest quarter of Section 28, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, in the County of Orange, State of California, now is in "RS -A-43,000" RESIDENTIAL/AGRICULTURAL ZONE and that it be changed to and incorporated in "RS -7200" RESIDENTIAL, SINGLE- FAMILY ZONE, subject to the following conditions: -1- 78-79-20 ATT Y-2 8 1. That street lighting facilities along Orangewood Avenue shall be installed prior to final building and zoning inspections unless otherwise approved by the Director of Public Utilities, and in accordance with standard specifications on file in the office of the Director of Public Utilities; and/or that a bond, certifi- cate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the installation of the above-mentioned require- ments prior to occupancy. 2. That subject property shall be served by underground utilities. 3. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 4. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 5. An ordinance rezoning the subject property shall in no event become effective except upon or following the recordation of a final tract map approved by the City Council. 6. That all private streets shall be developed in accordance with the City of Anaheim's standards for private streets. 7. That fire hydrants shall be installed and charged, as required and determined to be necessary by the Chief of the Fire Department, prior to commencement of structural framing. 8. That the owners of subject property shall pay the resi- dential traffic signal assessment fee (Council Policy No. 214) amounting to $36.00 per each new dwelling unit prior to the issu- ance of a building permit. g. Prior to the introduction of an ordinance rezoning sub- ject property, Condition Nos. 1 and 5, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the Planning Commission unless said conditions are complied with within one year from the date hereof, or such further time as the Planning Commission may -rant. 10. That Condition Nos. 1, 2 and 4, above mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added �o the City Zoning Map showing the changes hereby approved and adopted. -2- SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
