AN ORDINANCE OF THE CITY OF ANAHEIM ADDING
NEW CHAPTER 14.58 TO TITLE 14 OF THE ANAHEIM
MUNICIPAL CODE RELATING TO TRAFFIC'SIGNAL FEES.
THE CITY. COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN
AS FOLLOWS:
SECTION 1.
That new Chapter 14.58 be,. and the same is hereby,
added to Title .14 of the Anaheim Municipal Code .to read as
follows:

TRAFFIC SIGNAL FEES
Section 14.58.010. Method
The'City Council finds -and determines that .there
exists within the'City of Anaheim, principally in
the .area of new construction, traffic problems beyond
the financial ability of the'City to control. Itis,
therefore, necessary in order to promote the public
health, safety, and welfare, that the .City Council
establish a traffic signal fee to be applied to new
development -in the :City of Anaheim.
Section 14.58.020 Exemption
The -City Council finds and determines. that
Redevelopment projects within Redevelopment Project
Area Alpha should be. exempt -from payment of all
traffic signal fees when the Executive Director of
the Community Development Department certifies there
are sufficient funds available within Redevelopment
Project Area Alpha to. erect or modify existing traffic
signals in said Area'.
Section 14.58.030 Resolution
--- The City Council shall, by resolution, from time
to time designate the amount of fees necessary to be
collected by the'Building Division as a condition to
the issuance of a building permit for each: (l.) new..
dwelling unit, (2) commercial building, and (3) indus-
trial building.

Section 14.58.04.0. Special Fund
The City Council directs that all funds
collected pursuant,to.this Chapter, shall be
deposited in a special account and used to.provide
new traffic signals and/or modify existing traffic
signals throughout the City as determined by
established methods or prioritizing by the City
Engineering Division.
The .City Council, by resolution, authorizes
the .transfer of a portion or all of the special
fund to any other fund that the -Council shall
determine is necessary for the public health,
safety, and welfare of the citizens of the .City of
Anaheim."
'SECTION 2.
That, to the extent consistent herewith, the provi-
sions of this ordinance are hereby declared to be. a restatement
and reenactment of the traffic signal assessment procedures and
fees. heretofore adopted and imposed by any previous ordinance,
resolution, or policy of the :City of Anaheim. Any traffic
signal fees heretofore imposed and collected pursuant to any
such former ordinance, resolution, or policy are hereby express-
ly validated, ratified and approved notwithstanding any other
provision of this ordinance to the contrary.
SEC.TION 3._
SEVERABILITY. The City Council of the City of Anaheim
hereby declares that should any section, paragraph, sentence or
word of this chapter of the Code hereby adopted be declared for
any reason to be Invalid, it is the intent of the .Council that
it would have passed all other portions of this chapter
independent of the elimination herefrom of any such portion as
may be 'declared invalid.
SECTION 4. -
The City Clerk shall certify to the passage of this
ordinance .and shall cause the same .to be printed once within
fifteen (15) days after its adoption in the Anaheim Bulletin,

a newspaper of general circulation, printed, published and
circulated in said City, and thirty (30) days from and after
its final passage, it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and adopted by
the City Council of the City of Anaheim this 8�day of
August , 1978.
