3885ORDINANCE N0. 3885 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. �3IL-248 & 74B=209. determining that a change or changes in the zone or zones hereinafter mentioned and described should he made as hereinafter set forth after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, said Resolution did impose certain conditions and requirements precedent to the adoption of an ordinance chang- ing said zone or zones, which conditions and requirements have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anahein, County of Orange, State of California, described as follows, to wit: Tract Map 9721 as shown in book 428,.pages 13-18 of ni.scellaneous Maps on file in the office of the recorder of Orange County, Calif., now is. "RS -A-43,000 (SC) " RESIDENTIAL/AGRICULTURAL (SCENIC CORRIDOR OVERLAY) ZONE and that it be changed to and incorporated.in "RS-HS-22,000(SC)II RESIDENNTIALr SINGLE-FAMILY HILLSIDE (SCENIC CORRIDOR OVERLAY) ZOiqE, subject to the following conditions: 1. That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be co::tplied with as required by the City Engineer and in accordance with stand- ard plans and specifications on file in the office of the City Engineer at the'time the property is developed. -1- 72-73-51(20) ATTY-50 2. That the owner(s) of subject property shall install street lighting on all streets within the area as required by the Director of Public Utilities at the time the property is developed. 3. That electrical utilities shall be placed underground and dedicated to the City of Anaheim in accordance with the require- ments of the Director of Public Utilities. 4. That drainage of said property shall be disposed of in a manner satisfactory to the City Engineer. If, in the preparation of the site, sufficient grading is required to necessitate a grad- ing permit, no work on grading will be permittee? between October 15th and April 15th unless all required off-site drainage facili- ties have been installed and are operative. Positive assurance shall be provided the City that such drainage facilities will be completed prior to October 15th. Necessary right-of-way for off- site drainage facilities shall be dedicated to the City, or the City Council shall have initiated condemnation proceedings there- for (the cost of which shall be borne by the developer) prior to commencement of grading operations. The requires: drainage facili- ties shall be of a size and type sufficient to carry runoff waters originating from higher properties through said property to ulti- mate disposal as approved by the City Engineer. Said drainage facilities shall be the first item of construction and shall be completed and be functional throughout the tract and from the down- stream boundary of the property to the ultimate point of disposal prior to the issuance of any final building inspections or occa- pancy permits. Drainage district reimbursement agree-raents may be made available to the developers of said property upon their request. 5. That prior to the approval of the Final Tract 14ap, floor plans and elevation for the proposed houses shall be submitted to and approved by the City Planning Commission and the City Council. In cases where a parcel map may be permittee by law, floor plans and elevations for the proposed houses shall be submitted to and approved by the Planning Department prior to issuance of a building permit. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning 11-1ap showing the changes hereby approved and adopted. -2- SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the sasre to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin., a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall tape effect and be in full force.
