3864FOLLOWS: ORDINAT_vCE 1170 a - 3864 AN ORDINANCE OF THE CITY OF ANAHEIM ADDING NEW CHAPTER 15.06 TO TITLE 15. OF THE ANAHEIM MUNICIPAL CODE AND ADOPTING BY REFERENCE THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, 1976 EDITION, AS PROMULGATED BY THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, WITH CERTAIN AMENDMENTS THERETO. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That new Chapter 15.06 be, and the same is hereby, added to Title.15 of the Anaheim Municipal Code to read as follows: "CHAPTER 15.06 CODE FOR ABATEMENT OF DANGEPOUS BUILDINGS SECTION 15.06.001 APPROVAL OF CODE The City Council does hereby find and determine, as the result of investigation and tests conducted by the City and its Building Official, that the Uniform Code for the Abatement of Dangerous Buildings, 1976 Edition, as prom- ulgated by the International Conference of Building Officials, is an approved Code for adoption by reference within the meaning of Section 50022.1 of the Government Code of the State of California. SECTION 15.06.010 ADOPTION OF CODE Pursuant to the provisions of Sections 50022.1 to 50022.8, inclusive, of the Government Code of the State of Califor- nia, the City of Anaheim does hereby adopt by reference the Uniform Code for the Abatement of Dangerous Buildings, 1976 Edition,.as promulgated by the International Confer- ence of Building Officials, as amended herein; three (3) copies of said Code shall be filed in the office of the City Clerk of the City of Anaheim at least fifteen (15) days preceding the hearing provided for in Section 50022.3 of the Government Code and shall be kept there for public -- inspection while said Code is in force; all of which copies shall be certified to be true copies by the City Clerk; following the adoption of said Code, the City Clerk shall at all titres maintain a reasonable supply of copies of said Code available for purchase by the public. -1- SECTION15.06.201 ADMINISTRATION Section 201(a) of the Uniform Code for the Abatement of Dangerous Buildings is hereby amended to read as follows: Section 201(a). Administration. The Building Offi- cial of the City of Anaheim, as designated pursuant to Section 15.04.201 of the Anaheim Municipal Code, is hereby authorized to enforce the provisions of this Code. SECTION 15.06.205 BOARD OF APPEALS Section 205 of the Uniform Code for the Abatement of Dangerous Buildings is hereby amended to read as follows: Section 205. In order to provide for final inter- pretation of the provisions of this Code and to hear appeals provided for hereunder, there is hereby established a Board of Appeals. The Board of Appeals shall be the City Council of the City of Anaheim. The Building Official shall be an ex officio member of and shall act as Secretary to, said Board. The Board may adopt reasonable rules and regulations for conducting its business and shall render all decisions and findings -in writing to the Building Official with a duplicate copy to the appellant -and may adopt such.new legislation as is consistent therewith. Appeals to the Board shall be processed in accordance with :the provisions of Section 501 of this Code. Copies of any rules or regulations adopted by the Board shall be- delivered to the Building official who shall make them freely accessible to'the public." SECTION .2.. It shall be unlawful for any person, firm -or corpora- tion to violate -any provision or to fail to comply withany of the requirements of this ordinance. Any person, firm or corpor- ation violating any provision of this ordinance or failing to comply with any of its requirements shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding Five Hundred Dollars ($.500.00). or by imprison- ment not exceeding six (6.) months, or by both such fine and im- prisonment. Each'such person,.firm or corporation shall be deemed guilty of a separate offense for each'day during any por- tion of which any violation of any of the provisions of this -2- ordinance is committed, continued or permitted by such person, firm or corporation, and shall be punishable therefor as pro- vided for in this ordinance. SECTION' 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph,:.sentence or word of this chap- ter of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. SECTION' 4. The City Clerk shall certify to. the passageof this or- dinance and shall cause the same to be printed once within -fifteen (15) days after its adoption in the Anaheim Bulletin, .a newspaper of general circulation,.printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
