66-242WHEREAS, an agreement was entered into by and between
the City of Anaheim and Louis E. Nohl and Margaret E. Nohl on
the 1st day of December, 1964 wherein the said Nohls conveyed
to the City certain easements; and
WHEREAS, pursuant to said agreement, the City paid
said Nohls for damages to orchards resulting from construction
activities; and
WHEREAS, said Nohls and the City contemplated the
destruction of 100 trees at $50.00 per tree under the plans as
they existed at the time the agreement of December 1, 1964 was
executed; and
WHEREAS, due to changes in the design and plans in
the construction activities, an additional 64 trees were des-
troyed over and above the hereinabove mentioned 100 trees; and
WHEREAS, Louis E. Nohl and Margaret E. Nohl have not
been compensated for the additional 64 trees which were des-
troyed; and
WHEREAS, the parties desire to enter into an amend-
ment to the agreement entered into on December 1, 1964, providing
for payment for said additional 64 trees which were destroyed.
NOW, THEREFORE BE IT RESOLVED by the City Council
of the City of Anaheim that the agreement entered into on
December 1, 1964 by and between Louis E. Nohl and Margaret E.
Nohl and the City of Anaheim, be amended as follows:
That Paragraph 7 of said agreement shall be amended
to read as follows:
"7. GRANTEE shall pay to GRANTORS for easements
described heretofore and for the damages resulting from
all construction activities, the sum of Eight Thousand
Two Hundred Dollars ($8,200.00)."
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute such amendment to
said agreement of December 1, 1964, for and on behalf of the
City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 29th day of March, 1966.
