59R-5409 RESOLUTIO"l NO. 5409 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FIXING RATES FOR GENERAL WATER SERVICE AND CONNECTIONS, AND FIXING CHARGES FOR THE INSTALLATION OF WATER MAINS FOR WATER FURNISHED TO CONSUMERS AND FOR ALL SERVICES RENDERED IN CONNECTION THERE- WITH AND REPLACING RESOLUTIONS NO. 1824, 1836, 2349 AND 2393. WHEREAS, the City of Anaheim maintains a water distribution system for the furnishing of water to residents and inhabitants of the City of Anaheim, and WHEREAS, the Ci ty sells surplus water outside the Ci ty Umi ts pursuant to the provisions of Statutes of 1911, Chapter 715, of the State of California, and WHEREAS, it is desirable and necessary that certain rules and regulations be established and that charges for installation and services be fixed, and WHEREAS, Section 7400.48 of the Anaheim Municipal Code provides that the City Council shall by Resolution fix instal~tion charges and establish rates to be charged by the City of Anaheim for water installation and water furnished to consumers and services rendered in connection therewith. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the following rules and regulations for water installation heretofore or here- after made and rates for such installation and for water furnished and for services rendered in connection therewith be, and the same are hereby established as follows, to wi t: 1. SUPPLY TO PREMISES UNDER SINGLE OWNERSHIP INSIDE CITY, OCCUPIED BY TWO OR MORE INDIVIDUAL CONSUMERS OF WATER. No service connection for water shall be made inside the City Limits for the purpose of supplying through a common service, two or more independent con- sumers occupying premises held under the same ownership, unless said premises are located on the same lot or the property is what is known as a court, apartment house, or block, covering more than one lot, then only provided the owner or operator of such premises shall guarantee payment of all bills for water and water service. 2. SUPDLY TO PREMISES UNDER SINGLE OWNERSHIP OUTSIDE CITY, OCCUPIED BY TWO OR MORE INDIVIDUAL CONSUMERS OF WATER AND TWO OR MORE OWNED PARCELS OF PROPERTY INSIDE OR OUTSIDE THE CITY. No service connection for water shall be made outside the City Limits for the purpose of supplying through a common service, two or more independent consumers occupying premises held under the same ownership, or to two or more parcels of property separately owned, either inside or outside the City Limits, through a common service, except when the Department does not have facilities available to render individual service to each separate consumer. In such case, permission for common use of a service may be granted only provided: (a) That the consumer first in order of service shall guarantee payment of all bills for water service, and Ib) That all bills for water and water service shall be rendered on the basis of all minimum charges and all quantities of rate blocks multiplied by the number of individual Consumers so served, and served 30 days (c) That the consumer second in order of service, and any other consumers secondarily, shall agree to take and pay for an individual service within of notification by the Department of its availability. 3. RESALE OF WATER. Except as may be permitted by special agreement with the Department, no consumer sha 11 rese 11 any of the wa ter TE cei ved by him from the Department. Wa ter used by any consumer shall be restricted to that use specified in his application for service. 4. USE OF SERVICE CONNECTION WHEN PROPERTY IS SUBDIVIDED. When property provided with a service connection is subdivided, the service connection shall be considered as belonging to the lot or parcel of land it directly enters. 5. WATER MAIN EXTENSIONS, Unless the City Council finds that the number of users seeking the laying or extension are not sufficient to justify such laying or extending, the cost of all water mains installed or extended shall be borne by the owner or owners of the property abutting such mains according to the following policies: (a) Water mains installed or extended on dedicated streets and serving property wi thin the Ci ty Limits as they existed on May 20, 1924, at the time of election on Waterworks Bond issue shall be laid at the expense of the City of Anaheim. (b) The total cost of water mains installed or extended in the Helen 8. Lynch, Industrial Tract and Commercial Street Annexations shall be borne by the owners of property abutting such mains since said annexations did not participate in the Waterworks Bond payments. (c) Cost of installing or extending water mains on dedicated streets and serving property within the following annexations shall be borne as shown below, based on degree of participation in Waterworks Bond payments: ANNEXATION % OF COST TO % OF COST TO PROPERTY OWNERS CITY # 7 Kirven Annexation 8L5% 18.5% # 8 East Anaheim Extension 85.2% 14.8% # 9 So. Palm St. Annexation #2 96.3% 3.7% (d) All water mains installed or extended on streets dedicated or annexed to the City of Anaheim subsequent to January 1, 1950, or on any streets in new subdivisions shall be paid for by the owners of property abutting such instal- lation or extension. The cost to each property owner, whether served at the time of extension or installation or at some future time shall be based upon the total cost of the water main installation or extension completely across the footage of the property abutting the street in which the main is laid. (e) Replacement of all mains greater than 3" shall be at Ci ty expense. The cost of replacing 3" or smaller shall be in accordance wi th the policies out- lined in sub-paragraphs a, b, c, and d. 6. RATES INSIDE THE CITY LIMITS. 1. The rates applicable to all consumers of water from City owned and maintained water mains within the City limits of the City of Anaheim. Rate: First 750 cubic feet or less $2.00 Next 49,250 cubi c feet .14 per 100 cu. ft. Next 50,000 cubic feet .12 per 100 cu. ft. Over 100,000 cubic feet . lIt per 100 cu. ft. Minimum Charges: (a) For meter services through: 3/4" Pipe $2.00 3" Pipe $11.00 1" Pipe 3.00 4" Pipe 16.00 It" Pipe 4.75 6" Pipe 32.00 2" Pipe 7000 8" Pipe 55.00 10" Pipe 75.00 (b) When water is supplied to more than one lot or more than one dwelling or building occupied by more than one family through one meter service, an additional charge of 30~ per dwelling unit will be made. 7. RATES OUTSIDE CITY LIMITS. 1. Applicable to all consumers of water outside the City limits of the City of Anaheim from City owned and maintained water mains: Rate: First Over 750 cubic feet or less 750 cubic feet $4.00 .28 per 100 cu. ft. Minimum Charge: For service through: 3/4" Pipe 1" Pipe It" Pipe 2" Pipe $4.00 6.00 9.50 14.00 3" Pipe 4" Pipe 6" Pipe $22.00 32.00 64.00 Provided, however, that in territory capable of being annexed to the City of Anaheim where proceedings have been commenced in good faith for the annexation of said territory to the City of Anaheim and where a petition for annexation is filed with the City Clerk for the City of Anaheim signed by a majority of the registered voters registered and residing in said territory proposed to be annexed to the City, and by the owners of 51% of the value of the territory proposed to be annexed, as shown by the last equalized assessment role, and said proceedings are deli gently advanced, then, in that event, the water rates in such territory outside the City Limits, shall be the same as the rates within the City Limits, for a period of not to exceed six (6) months. If said proceedings are not diligently prosecuted to completion within said period of time above mentioned, or such further time as the City Council may grant, the rates for the sale and delivery of water outside the City of Anaheim shall be charged to the property owners within said territory. 8. RATES FOR PRIVATE FIRE LINES. SERVICE: For private fire lines used exclusively for fire protection whether said lines be connected with automatic sprinkling system or hose attachments. UNMETERED WATER DURING SUBDIVISION CONSTRUCTION. (a) All water to be used in construction for compaction, flooding of ditches and sprinkling to keep dust down, shall be paid for at the rate of $30.00 per acre; payment to be made in advance to the Engineering Department prior to tract approval. Service to be rendered out of existing fire hydrants nearest tract or development. Eddy valves and permits are required when taking water from any fire hydrant. The Water Department shall have the authority to stop all irregulari- ties that might affect the use of water or fire hydrants. Time limit on this service is 90 days. (b) The developer may make written request to the Utilities Department, Water Division, for permission to install spacers in meter boxes in tracts in lieu of meters during construction of houses, for a maximum period of 3 months. A meter will be required before any landscaping is done or house occupied. The Developer will also be required to obtain a "request for unmetered water" at the Water Division Office at 5lB South Los Angeles Street, which will state the tract number, lot numbers, time of expiration, etc. He will then make application to Customer Service at the City Hall, who will process the orders for this temporary service. Customer Service shall also keep a record in their meter books of expiration dates and advise the Water Division and Developer of the expiration date. A charge per lot ~hall be made during the 3 month period allowed, and Customer Service shall bill monthly as charges accrue. After the 3 month period has expired, and the Developer has not removed spacers, the City shall have the right to remove and charge the Developer for same and discontinue service to individual lots. Billing charges for such service shall be $1.50 per month per lot for a single unit, each unit in excess of one per building shall be charged 25 cents per uni t. (c) Tanker Wagons: All spray rigs and tankers may obtain special permits at the Water Division Office in the Utilities Building, 518 South Los Angeles Street. Water Division will regulate the use of water for this type of service. The rate charge for this service is .04 cents per 100 gallons of water. Eddy valves are required. The time limit for this type of service is 30 days per permi t. 10. DEPOSITS. The Accounting Division (Customer Utility Service) of the Finance Department shall require each consumer to deposit with the City a sum of money equal to the probable amounts as estimated by the accounting officer of a two months bill for the commodity to be supplied by such service. The minimum deposit shall be Ten ($10.00) Dollars. When a consumer has consistently paid his current bills promptly for a period of three years, then his deposit will be refunded. If at a later date a consumer allows his credit rating to become impaired, the accounting officer shall have the right to require that another deposit be made. 11. SERVICE CONNECTION CHARGES. (a) Installation Inside the City Limits: 3/4" Service 1" Service It" Service $ 65.00 90.00 IBO.OO Within tracts, the City will deduct $15.00 per installation where developer's contractor installs services. All water service connections requiring the installation of a 2" connection or larger, shall be made at a charge equivalent to the cost of installation. (b) Installation Outside City Limits: All equivalent to charge. water servi ce connections outside the Ci ty shall be made at a charge cost of installation including overhead plus a $25.00 facilities (c) The installation of any special services not covered by this Resolution, or specifically provided for in any other existing Ordinance or Resolution of the said City of Anaheim and any fire lines, shall be made on the basis of cost, including overhead. Application for such installations larger than It inch and special services and fire lines shall be made to the Utilities Department, Water Division, and the Utilities Director shall estimate the cost of said installation and shall then re- quire of the applicant a deposit of a sum of money equivalent to the estimated cost. In the event that the cost of said installation should be less than the amount so estimated, the excess, if any, shall be refunded to the applicant. If the cost of said installation exceeds the estimate so made, then the said Utilities Director shall make a further request upon the applicant for such additional sum as may be necessary to cover the cost. (d) If the installation requires an extra heavy cast iron meter box, an additional charge of $20.00 will be made. (e) Title to all equipment and materials furnished shall remain for all time in the said City of Anaheim. (f) Costs and specifications for installation and extensions shall be determined by the Utilities Director. BE IT FURTHER RESOLVED that Resolutions No. 1824, 1836, 2349 and 2393 be and the same are hereby rescinded. BE IT FURTHER RESOLVED that the above regulations and rates become effective immediately upon the adoption of this Resolution and shall continue thereafter until changed by the City Council of the City of Anaheim.
