3834ORDINANCE NO. 3834 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 71R-199 and 73g -fig determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, said Resolution did impose certain conditions and requirements precedent to the adoption of an ordinance chang- ing said zone or zones, which conditions and requirements have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Parcel 3, as shown on a map moiled in book 50, page 36 of Parcel Maps, records of said Orange County,. now is "RS -A-43,0.00" 12ESIDENTIAL/AGRICULTURAL ZONE and that it be changed to and incorporated in "CL" COVIt421-RCIAL, L11,1IT D ZONE, .sub- ject to the following conditions: 1. That subject property shall be served by underground utilities. 2... That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 3. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. -1- ATTY-50 71-72-7(2) 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 5. That any parking area lighting proposed shall be down - lighting of a maximum of twenty (20) feet high in accordance with approved plans submitted by the Applicant marked Exhibit No. 6. Said lighting shall be directed away from the property lines to protect the residential integrity of the area. 6. That the unpaved portion of Santa Ana Canyon Road right- of-way and the median strip in Imperial Highway for the length equal to the frontage of subject property shall be landscaped and that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance. Following installa- tion and acceptance, the City of Anaheim shall assume the responsi- bility for maintenance of said landscaping. 7. That dense landscaping shall be provided in the easement area adjacent to the residential uses abutting subject property to the south. 8. That an integrated sign identifying the shopping center shall be provided as submitted to the Planning Commission for approval and marked Exhibit No. 1. 9. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits No. 1, 2, 3, 4, 5, 6 and 7, provided, however, that plans for any roof -mounted equipment screening shall be submitted to and approved by the Planning Department to assure that they are in accordance with the Planning Commission's recom- mendations. 10. That Conditions No. 1, mentioned, shall be complied with ing inspections. SECTION 2. 2, 31, 4, 51, 6, 7, 8 and 9, above - prior to final building and zon- The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. -2- THE FOREGOING ORDINANCE is approved and adopted by the City Council of the City of Anaheim this 28th day of February , 1978.
