3829ORDINANCE NO. 3829 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. determining that a change or changes in the zone or zones hereinafter mentioned and described should he made as hereinafter set forth after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, said Resolution did impose certain conditions and requirements precedent to the adoption of an ordinance chang- ing said zone or zones, which conditions and requirements have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That certain parcel of land in the City of Anaheim, County of Orange, State of California, described as follows: Beginning at the Northwest corner of Lot 10 in Tract No. 7370, as per map recorded in Book 320, Pages 39 and 40 of Miscellaneous Maps, records of said Orange County, being at a point on the Northerly line of Parcel 3 as described in Deed recorded in Book 4668, Page 393, Official Records; thence along the Westerly line of said Tract No. 7370, South 00 10' 19" East (South 00 13' 48" East record as per said Tract) 798.68 feet to the Northerly line of McKinnon Drive, 60 feet wide, said point being the Southeasterly corner of the land conveyed to Jefferson Investment Affiliates, a Limited Partnership, by deed recorded -1- ATTY-50 7 3-7.4-37 July 20, 1973, in Book 10810, Page 531 Official Records; thence along the Southerly boundary of the land so conveyed South 770 13' 440 West 243.97 feet; thence North 120 46' 160 West, 2.00 feet; thence South 77° 13' 44" West 25.00 feet to the beginning of a tangent curve, concave Northeasterly,.having a radius of 15.00 feet; thence Northwesterly 20.48 feet along said curve through a central angle of 780 16' 16" to the beginning of a compound curve, concave Easterly, having a radius of 1747.00 feet, said com- pound curve being on the Easterly line of Lakeview Avenue, 106.00 feet wide, as described in the deed to the City of Anaheim, recorded November 6, 19708, in Book 9454, Page 647, Official Records; thence Northerly along said compound curve 78.56 feet through a central angle of 2° 34' 36"; thence tangent to said curve, North 210 55' 24" West 235.02 -feet to the Southeasterlv corner of Parcel 3 of deed recorded June 21,- 1971, in Book 9723, Page 486, Official Rec- ords, thence continuing North 210 55' 24" West 397.50 feet along the Easterly line of said Parcel 31 to the Northeasterly corner thereof, said corner being on the South line of deed recorded in Book 1062, Page 269, Official Records; thence along said South line North 700 02' 35" East 429.71 feet to an angle point therein; thence North 710 24' 01" East 146.37 feet to the point of beginning, now is "RS -A-43,000" RESIDENTIAL/AGRICULTURAL ZONE, and that it be changed to and incorporated in "CL" COMIERCLAL LIMITED ZONE, subject to the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 2. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 3. That a 20 -foot wide landscape strip shall be provided along the east property line and planted with 15 -gallon trees on 20 -foot centers,- with appropriate irrigation facilities as stipu- lated to by the petitioner. 4.. That the wall abutting the adjoining RS -7200 residential properties shall be six feet above the highest grade of either the subject property or said adjoining properties, whichever is high- est, as stipulated to by the petitioner. -2- 5. That -the trash storage area for the proposed medical facility shall be relocated away from the east property line abut- ting RS -7200 residential properties,.as stipulated to by the petitioner. 6. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent proper- ties. 7. That subject property shall be served by underground utilities. 8. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 9. That a modified cul-de-sac shall be provided at the terminus of Maychelle Drive subject to the approval of the City Engineer. 10. That grading, excavation, and all other construction activities shall be conducted in such a manner so as to minimize the possibility of any silt originating from this project being carried into the Santa Ana River by storm water originating from or flowing through this project. 11. That the vehicular and pedestrian access rights to May- chelle Drive shall be dedicated to the City of Anaheim. 12. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1, Revisions Nos. 1, 2, 3 and 4. 13. That Conditions No. 1, 2, 3, 4, 5, 6, 7,8, 9, 10, 11 and 12 shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning 14ap shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which'it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Hap showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. -3- City 1978.
