RESOLUTION NO. 5400
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEHi FINDING AND DETERI'IINING THAT A CHANGE OF
ZONE IS NECESSARY U, CERTAIN AREAS OF THE CITY,
AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM
MUNICIPAL CODE SHOULD BE ~lENDED TO ACCOMPLISH
SAID CHANGE OF ZONE.
WHEREAS. the City Planning Commission or the City or Anaheim
has heretofore duly passed and adopted a resolution declaring its inten~
tion to change the boundaries of the zone or zones hereinafter men-
tioned and described and did fix a time and place for the holding of
a public hearing thereon in the manner and as prescribed in Article
IX, Chapter 2 of the Anaheim Municipal Code. and did duly hold and
':onduct su~h public hearing to consider said proposed change of zone
or zones. and did receive evidence and reports from persons interested
Lherein; and
~rlEREAS. within a period of forty (40) days following the
final hearing thereon, the Planning Commission did duly announce by
formal resol1J.tion its findings of facts and declare its opinions and
reBsons for recommending an amendment to said Article IX. Chapter 2
of the Anaheim Municipal Code to effect the proposed changes in the
~oundaries or the zone hereinafter mentioned and described; and
WHEREAS. upon receipt of the report and recommendation of
the City Planning Commission. the City Council did thereupon fix the
4th day of August, 1959 , as the time and the
Council Chamber in the City Hall of the"'lrrty of Anaheim as the place
for a public hearing upon said proposed change or zone, and did give
notice thereof in the manner and as provided in said Article IX.
Chapter 2 of the Anaheim Municipal Code; and
WHEREAS 9 at the time and place fixed for said public hear-
ing, the City Council did duly hold and conduct such public hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports. and did thereupon con-
sjder the recommendations or the City Planning Commission; and
WHEREAS, the City Council does rind and determine that the
property and area proposed to be changed rrom the zone in which it
is now situated to a different zone. as hereinafter set forth. is
more suitable for the zone or zones to which it is proposed to
(change said propert;y and area and that the inclusion of said property
and area in such new zone or zones will increase the value of said
property and area and will not depreciate the values of property
in adjoining zones.
NOW,THEREFORE. BE IT RESOLVED by the City Council of the
City of Anaheim that all of the property and area situated in the
City of Anaheim. County of Orange, State of California, described
as rollows, to wit:
That portion of the Northwest quarter of the South-
west quarter of Section Seventeen, Township Four
South, Range Ten West, S.B.B.& M., described as follows:
Beginning at a point in the center line of Brookhurst
Street, said point being the Southwest corner of said
Northwest quarter of the Southwest quarter; thence

be changed from R-A, RESID1:.'NTIAL-AGRlCULTURAL ZONE to C-l,
NEIGHBORHOOD-COMMERCIAL ZONE, upon the following conditions:
1. That the owners 01' subject property place of
record standard City of Anaheim C-l Deed Re-
strictions, approved by the City Attorney, which
restrictions shall limit the uses of the property
to administrative or professional uses.
2. That the 1.JuildiI:cg to be erected on subject pro-
perty shall be constructed in accordance with the
plans this day presented to the City Council and
on file with the City of Anaheim, with parking
space provided as shown on the plot plan, but with
the exception that tho minimum building setback
line shall be reduced to six feet.
3. That a 6-foot masonry wall be erected along the
rear or east property line.
!{.. That the owners of subject property deed to the
City of Anaheim a strip of land 60 feet in width,
1'rom the center line of the street, along Brook-
hurst Street, for street-widening purposes.
5. (a) That all engineering requirements of the City
of Anaheim, such as curbs and gutters, sidewalks,
street grading and paving, drainage facilities or
other pertinent work, be complied with as required
by the City Engineer and in accordance with standard
plans and specifications on file in the office of
the City Engineer; and (b) that a bond in an amount
and form satisfactory to the City of Anaheim be
pos ted wi t:b the Ci ty to guarantee the installation
of said engineering requ:l.rement s.

BE IT F'URTHER RESOLVED tha t the Ci ty Attorney be, and he
is hereby authorized and directed to prepare and submit to the City
Council an amendment to Article IX, Chapter 2 of the Anaheim Muni-
cipal Code to amend said Anaheim Municipal Code to accomplish the
object her'ein found and determined to be necessary and proper.
