3812ORDINANCE NO, 3812 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 74R-30 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth; after duly noticed hearings -and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones,- which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the bound- aries of the zones set -forth in said Title 18 by adopting a sec- tional zoning map or maps showing such change or changes as follows: That all of the area situated in theCity of Anaheim, County of Orange, State of California, described as follows,- to wit: That portion of Lot 7 of Tract No. 936, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 30 Pages 1 and 2 of Mis- cellaneous Maps, in the Office of the County Recorder of said County, lying northerly of the center line of the land described in the Deed to the State of Cali- fornia, recorded May 26, 1948 in Book 1643 Page 306. of Official Records. Except that portion thereof that is included within that certain 19.50 feet by 74.00 feet of land conveyed to Vicente Yorba and wife, by Deed recorded August 1, 1939 in Book 1002 Page'533 of Official -Records, now .is %S-A-43,0001SC)'" RESIDENTIAL/AGRICULTURAL (SCENIC CORRIDOR OVERLAY). ZONE and that it be changed to and incorporated in "CL(SC)" COMMERCIAL, LIMITED (SCENIC CORRIDOR OVERLAY). ZONE, subject to the following conditions: -1- 73-74-25 1. That the future street on the west side of subject property shall be developed as an ultimate sixty -foot (6.01) wide street with'a full -traveled way and one parkway constructed within the development of this property. 2. That a modified cul-de-sac shall be provided at the pro- posed easterly terminus of "old" Santa Ana Canyon Road. 3. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 4. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. S. That subject property shall be served by underground utilities. 6. That drainage of said property shall be disposed of in a manner satisfactory to. the City Engineer. If, in the prepara- tion of the site, sufficient grading is required to necessitate a grading permit, no work on grading will be permitted between October 15 th and April 15th unless all required off-site drainage facilities have been installed and are operative. Positive assur- ance shall be provided the City that such drainage facilities will be completed prior to -October 15th. Necessary right-of-way for off-site drainage facilities shall be dedicated to the City, or the City Council shall have initiated condemnation proceedings therefor (the costs of which shall be borne by the developer) prior to the commencement of grading operations. The required drainage facilities shall be of'a size and type sufficient to carry runoff waters originating from higher properties through said property to ultimate disposal as -approved by the City Engineer. Said drainage facilities shall be the first item of construction and shall be completed and be functional throughout the tract and from the downstream boundary of the property to the ultimate point of disposal prior to the issuance of any final building inspections or occupancy permits. Drainage district reimbursement agreements may be made available to the developers of said property upon their request. 7. That grading, excavation, and all other construction ac- tivities shall be conducted in such a manner so as to minimize the possibility of any silt originating from this project being carried into the Santa Ana ,R.iver by storm water originating from or flowing through this project. 8. That reasonable landscaping, including irrigation facili- ties, shall be installed in the median and unpaved portion of the Santa Ana Canyon Road parkway in accordance with plans for said landscaping to be submitted to and approved by the Parkway Mainten- ance Superintendent. Following installation and acceptance, the City of Anaheim shall assume the responsibility for maintenance of said landscaping. -2- 9. The City Council reserves the right to delete or amend the assumption of landscape maintenance in the event Council policy changes. 10. That Condition Nos. 1, 2, 3, 5, 6 and 8, above men-tioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, asamended, is hereby adopted and the City Engi- neer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (3.0) days -from and after its final passage, it shall take effect and be in full force.
