RESOLUTION NO. 5390
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING TEMPORARY WAIVER OF SIDE-
WALK REQUIREMENTS ON PROPERTY LOCATED AT 1025
ACACIA STREET, ANAHEIM CALIFORNIA; AND AUTHOR-
IZING AND DIRECTING THE CITY CLERK TO PLACE A
COPY OF THIS RESOLUTION OF RECORD IN THE OFFICE
OF THE COUNTY RECORDER OF ORANGE COUNTY.
\iHEREAS, Article VIII, Chapter l-B, Sections 8150
and 8150.1 of the Anaheim Municipal Code require the con-
struction of cement curbs, gutters and sidewalks by anyone
constructing any building or dwelling within the City of
Anaheim, where said improvements do not already exist; and
WHEREAS, a waiver of sidewalk requirements has been
requested for the property located at 1025 Acacia Street, in
the City of Anaheim, County of Orange, State of California,
more particularly described as follows:
That portion of Lot 24 of Golden State Tract No.2,
in the City of Anaheim, County of Orange, State of
California, as per map recorded in Book 4, Page 68
of Miscellaneous Maps, in the office of the County
Recorder of said county, described as follows:
Beginning at a point on the Easterly line of said
Lot 24, distant North 00 48' 10" West 345.00 feet
from the Southeast corner of said Lot 24, said
Southeast corner also being the center line inter-
section of East La Palma Avenue and Acacia Street,
as shown on a map of Tract No. 1364, recorded in
Book 52, Pages 42 and 43, Miscellaneous Maps, records
of said Orange County; thence West, parallel with
the South line of said Lot 24, a distance of 155.00
feet to the East line of said Tract No. 1364; thence
North 00 48' 10" West along said last mentioned
East line, 60.72 feet to the Southwest corner of the
land described in deed to Henry Gutierrez, et ux.,
recorded in Book 2925, Page 117, Official Records,
in the office of the County Recorder of said Orange
County; thence East, along the Southerly line of
said land conveyed to Henry Gutierrez, 155.00 feet
to the Easterly line of said Lot 24; thence South
00 48' 10" East, along said East line, 60.72 feet
to the point of beginning.
NOTE: Said land is shown on a map of survey, re-
corded in Book 24, Page 31, Record of Surveys, in
the office of the County Recorder of said county.
AND WHEREAS, the City Council does find and determine
that there is no present need for such improvement and that a
temporary waiver of the requirement thereof should be granted
until such time as sidewalks are found to be necessary and
required by the City Engineer;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that a temporary waiver of sidewalk
requirements for the property hereinabove described located at
1025 Acacia Street, Anaheim, California, be, and the same is

hereby granted until such time as the said improvement shall
be deemed necessary and requested by the City Engineer.
BE IT FURTHER RESOLVED that the City Clerk be, and
she is hereby authorized and directed to cause a certified
copy of this resolution to be placed of record in the Office
of the County Recorder of Orange County, California.
THE FOREGOING RESOLUTION is approved and signed by
me this 28th day of July, 1959.

Schutte.
NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: None.
AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said resolution on the 28th day of
July, 1959.
