RESOLUTION NO. 5384
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM DENYING VARIANCE NOo 1134
WHEREAS, the City Planning Commission of the City of Ana-
heim did receive a petition for zoning variance from DONALD F. KRRBS,
owner of certain real property
situated in the City of Anaheim, County of Orange, State of California,
described as follows~
Lot No. 79 of Tract No. 2296.
(Said property is located at 814 North Modena
Street, Anaheim, California.)
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim on June 2q
, 19 59 ~ notices of which said public hearing were duly
given as required by law and the provisions of Section 9200.17 of the
Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due inspec-
tion, investigation and studies made by itself and in its behalf, and
after due consideration of all evidence and reports offered at said
hearing, did adopt Resolution No. 271 , Series 19 ~8-~q , reBommend-
ing that Variance No. lli4 be ~ranted : and
WHEREAS, thereafter, within twenty (20) days from the date
of the adoption of said resolution, the City Council did elect, upon
its own motion, to review the action taken by the City Planning Com-
mission in ~rant~~ said variance and did set a public hearing
thereon to be hel on the 28th day of .Tu11, ,qC;q , at 7:00
oVclock P.M. in the City Hall in the City of Anaheim, and notice of
such public hearing was duly given as required by law and the provi-
sions of Section 9200e17 of the Anaheim Municipal Code; and
WHEREAS, the City Council does find that:
1. There is no substantial property right possessed by
other property in the same vicinity and tone and
denied the subject propertYe
2e It appears that the subject property can be ade-
quately developed and used under the present zonae

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the action of the City Planning Commission granting
Variance No. 1134 to allow construction of a six-foot fence to extend
eight and one-half feet into the front yard of the property hereinabove
described to enclose a swin~ing pool, be and the same is hereby dis-
approved, and that Variance No. 1134 be, and the sarne is hereby denied.
