RESOLUTION NO. W.2.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING RESOLUTION NO. 5349 IN
RECLASSIFICATION PROCEEDINGS NO. F-58-59-99.
WHEREAS, the City Council of the City of Anaheim did
heretofore, to wit, on the 14th day of July, 1959, adopt Reso-
lution No. 5349 in reclassification proceedings No. F-58-59-99,
upon application from The Central Baptist Church of Orange County
for a change of zone of certain real property described in said
application; and
WHEREAS, the City Council finds that through oversight
the requirement for the payment of $25.00 per dwelling unit was
omitted from said resolution and that Resolution No. 5349 should,
therefore, be amended by adding a new condition requiring the
owner of the property to pay to the City of Anaheim the sum of
$25.00 per dwelling unit to be used for park and recreation
purposes, said sum to be paid at the time the building permit
is obtained; and
WHEREAS, the City Council does further find that an
ordinance has never been adopted directing said change of zone
and completing said reclassification proceedings;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Resolution No. 5349 in reclassification
proceedings No. F-58-59-99 be, and the same is hereby, amended
by including an additional condition, reading as follows:
"That the owner of subject property pay to the City
of Anaheim the sum of $25.00 per dwelling unit to
be used for park and recreation purposes, said sum to
be paid at the time the building permit is granted."
BE IT FURTHER RESOLVED that in all other respects said
Resolution No. 5349 be and remain in full force and effect.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an amendment to Article IX, Chapter 2 of the
Anaheim Municipal Code to amend said Anaheim Municipal Code to
accomplish the object herein found and determined to be neces-
sary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 21st day of July, 1959.
