RESOLUTION NO. 5363 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AOKNOWLEDGING REOEIPT OF A PETITION FOR THE ANNEXATION OF OERTAIN UNINHABITED TERRITORY TO THE CITY OF ANAHEIM, DESIGNATING THE TERRITORY AS THE PLACENTIA-CERRlTOS ANNEXATION ; DESCRIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLAOE WHERE AND WHEN .ANY PERSON OWNIJlG REAL PROPERTY WITHIN SUOH TERRITORY SO PROPOSED TO BE ANIEXED MAY APPEAR BEFORE THE OITY COUNOIL AND SHOW CAUSE WHY SUOH TERRITORY SHOULD NOT BE ARJiEXED TO THE CITY OF ANAHEIM. WHEREAS, the City Oouncil of the Oity of Anaheim did on the lllt.h day of July , 19..5.9-, reoeive a written petition asking that oertain new territory described in said petition be annexed to the Oity of Anaheim; and WHEREAS, before the filing of said petition, the proposal for the annexation of the territory hereinafter described to the Oity of Anaheim was submitted to the Boundary Commission of the County of Orange, State of California, and reported upon by said Boundary Commission with respeot to the definiteness and certainty of the proposed boundaries; and WHEREAS, said territory proposed to be annexed to said Oity of Anaheim is situated in the Oounty of Orange. State of California, and is contiguous to the City of Anaheim and is uninhabited territory, and said petition contained a description of said territory in words and figures as hereinafter in this Resolution desoribed; and WHEREAS, the City Counoil finds from evidenoe and reports reoeived that at the time of the filing and receipt of said petition, it was and now is signed by owners of not less than one-fourth (t) of the land in the territory by area and by assessed value in the territory proposed to be annexed, according to the last preceding equalized county assessment roll; and WHEREAS, the City Oouncil finds from evidenoe and reports reoeived and from said petition that at the time of the filing and presentation of said petition that said new territory proposed to be annexed to said City of Anaheim did not fOrm a part of any municipal oorporation and that said territory was uninhabited and is contiguous to the Oity of Anaheim; and WHEREAS, the City Council finds from said petition and evidenoe and reports received that the boundaries of the territory so proposed to be annexed to the City of Anaheim are as follows, to wit: /"",""" -1- ,,-. r P~ACEN: . A-CER'l ,ros ANNEXAT: ON That parcel of land located in the County of Orange, State of California, being a portion of Sections 24 and 25 of Township 4 South, Range 10 West, S.B.8. & M., described as follows: Beginning at a point in the existing City Limit lines, said point being the southwest corner of the Southeast Annexation to the Ci ty of Anaheim; as passed by Ordinance No. 1104 on November 27. 1956, and filed with the Secretary of Sta'e on Decel'1ber 31, 1956; thence, 1, Easterly and northeasterly along the existing Anaheim City Li~it line to its point of intersection with the east line of the west half of the northwest quarter of Section 24, Township 4 South, Range 10 West, S.B.B. & M.. said point also being in the northerly right-of-way line of the Southern Pacific Railroad Co~pany right-of-way (50 feet wide); thence, 2. Northeasterly along the north right-of-way line of the said Southern Pacific Rai lroad right-of-way to the point of intersection with the easterly line of the Rancho San .uan Cajon De Santa Ana Rancho line, as said Rancho line i~ recorded on ;u1v 9, 1897 in Book 2, Page 256 of Patients, Records of Los Angeles County, California; thence, 3. Southwesterly along the last mentioned Rancho line to its poin" of intersection with the southerly right-of-way line of Struck Avenue (40 feet wide) as said Struck Avenue was conveyed to Orange County, California, bv Document recorded October 27, 1922, in Book 441, Page 337 of Deeds, Records of Orange County, California; thence, 4. Southeasterly and easterly along the southerly right-of-way line of Struck Avenue to its intersection with the east line of Lot 7 of the Travis Tract, as shown on a ~ap fi led in Book 5, Page 120, Miscellaneous Records of Los Angeles County, California; thence, 5. Southwesterly along the east line of Lot 7 of said Travis Tract to its point of intersection with the existing Anaheim City Limit lines as established by the Katel1a Annexation to the City of Anaheim, passed by Ordi nance No. 1119, .January 30, 1957, and fi led wi th the Secretary of State March 4, 1957; thence, 6. Northwesterly along the existing Anaheim City Limit line to a -2- ...""'-'" - r ,- - point in a line parallel with and 30.00 feet easterly of the west line of Section 24, Township 4 South, Range 10 West, S.B.B. & M., said point also being in the existing City of Anaheim City limit lines as established by the Placentia Ball Annexation to the City of Anaheim, as passed by Ordinance No. 1018, September 27,1955 and filed with the Secretary of State, October 28, 1955; thence, 7. Northerly along the last mentioned parallel line and said existing City of Anahei~ City limit lines to the point of beginning. -3- - ~ NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that such proposed annexation be designated as IIPLACENTlA-CERRITOS ,AHNEXATION" and. that notice of such proposed annexation be hereby given as hereinafter pro'\flded. BE IT FURTHER RESOLVED that a public hearing shall be had upon the date set, not less than forty {40) nor more than sixty (60) days after the passage of this Resolution, unless the owner or owners of all of the territory to be annexed r~ve petitioned for annexation or filed their consents to such annexation, in writing, with the City Council, in whioh event the hearing shall be set at any time after compliance with Sectlor: 353H of the Government Code. AND BE IT FURTHER RESOLVED that the City Council does find that the owner Or owners of all of the territory proposed to be annexed have noL ~ petitioned for annexation Or filed their consents to suoh annexation f in wri tlng, with the Ci ty Council. BE IT FURTHER RESOLVED that the 25th day of Auaust 19~>> at the hour of 7:00~~ o'clock ~., at the City Council Chamber in the City Hall of the City of Anaheim be. and the same is hereby" fixed as the day? hour and place when and where the City Council will hear protests made by any owner or owners of real property within the territory proposed to be annexed;; and that at any time before the hour set for hearing objections" any owner of property wHhln Baid territory may file with the Oity Clerk a written protest against the annexation" Said protest shall be in writing and shall state the name of the owner of the property affected and the description and area of the property in general terms. .
