ANAHEIM FINALLY ACCEPTING THE COMPLETION AND THE
FURNISHING OF ALL PLAII!' D LABOR, SERVICES~ )(A..,
TERIALS AND EQUIPMENT AND ALL UTILITIES AND TRANs..
PORTATION INCLUDING POWER, FUEL AND WATER, AND
PERFORMING ALL WORK NECESSARY TO CONSTRUCT AND
COMPLETE TFm FOLLOWING PUBLIC IMPROVEMENT, TO WIT:
THE SOUTH LOS ANGELES STREET SEWER IMPROVEMENT.
FROM 1006 FEET NORTH OF ,KATELLA AVENUE TO KATELLA

WHEREAS" the City Oouncil of the City of Anaheim did
oause to, be published in a newspaper of general ciroulation,
printed, published and circulated in the City of. Anaheim, to wit:
The Anaheim Bulletin, on the 9t~ and 16th da;p of April ,
19~D a notice inviting sealed proposals for furnishing the
fol1owing~
All plant, labor, services, materials and equip-
ment, and all utilit~es and transportation, in-
cluding pwer, fuel and 1-Jater, and performing all

':,ooc. snd workmanlike manner, in strict accordance
with the specifications, plans and drawings there-
for on file in the office of the City Engineer or
':::ity Clerk of the City of Anaheim, the following
public improvement, to wit: The South Los Angeles
Street Sewer Improvement, consisting of the con-
struction of a 12-inch V.C.p. sewer lateral in
South Los Angeles Street from 1006 feet north of
Katella Avenue to Katella Avenue, including trench-
ing, backfill to flow line of water line, construc-
tion of 6-inch V.C.P. Type "A" house connections,
4-foot I.D. manholes, and appurtenant work as
indicated on the plans, Job No. 1156,

tions prepared by Thornton E. Piersall. Citv En~ineer.
and the notice inviting sealed proposals~ whioh said notice speoi-
fied that sealed proposals as speoified in said notioe would be
reoeived up until 2:00 o'olook PoKe of the =~1rd day of
April . . 19....2.2-9 and which said notice did state and
deolare that, pursuant to the provisions of Seotion 1770 of the
Labor Code. the City Counoil of the City of Anaheim had asoertained
the prevailing rate of wages for each type of labor needed to exe-
oute said oontract and did set forth the prevailing hourly wage
soale so asoertained; and
WHEREAS, on ADr~l 21 D 19~.at the hour of

City of Anaheim did open said sealed proposals received up to that
time for the furnishing of all plant>> labor, services. materials
and equipment. and all utilities and transportation~ including
power. fuel and water, and performing all work neoessary to con-
struct and complete. in a good and workmanlike manner. in strict
accordance with the specifications. plans and drawings therefor
on file in the Office of the City Clerk of the City of Anaheim.
the public improvement herelnabove more particularly desoribed and
set forth, in publ:l.o" :in the City Council Chamber in the City Hall,
Anaheim, California. and the City Engineer did tabulate the result
of said sealed proposals and did make a report to the City Council

WHEREAS. the Oity Council of the City of Anaheim did. at
its next ~egular meeting. held on the 28th day

oonsider the sealed proposals submitted for furnishing the materi-
als and performing the work hereinabove more partioularly desoribed
and set forth. and did thereupon find and determine that the sealed
proposal submitted by PLUMBING CONTRACTORS. INC.. SANITARY DIVISION,
11662 E. Westminster Avenue. Garden Grove, CalirorniR,
for the construotion>> installation and completion of said Job No.
1156. The South Los Angeles Street Sewer Improvement.
hereinabove mentioned and desoribed. was the lowest responsible
proposal submitted therefor>> and thereupon accepted said bid and
did award a contract to said ~_Plumbing Contractors. Inc.. Sanitary

for furnishing all plant>> labor" services, materials and equipment
and all utilities and transportationp including power. fuel and
water~ and performing all work necessary to construct and complete.
in a good and workmanlike manner, in strict accordance with the
specifications>> plans>> and drawings" the said pUblio improvement as

ize the Mayor and the City Clerk of the City of Anaheim to execute

plant. labor>> services, materials and equipment and all utilities
and transportation, and performed all work necessary fOr the oon-
struction and oompletion>> in a good and workmanlike manner. in
striot accordanoe with the speciflcations, plans. drawings. of said
pUblic improvement as speoified in the notice inviting sealed prO-
posals and in the detail. design, plans, profiles. drawings and
speoifications prepared by ~rnton E. Piersall. City Engineer.

WHEREAS~ the City Engineer "._has dull
certified to the construotion and completion of said pUblic improve-
ment hereinabove mentioned and desoribed, in aocordance with the
plans and speoifications and the contract documents duly made and

WHEREAS, the City Council finds that said oontractor has
oompleted said pUblic improvement hereinabove more particularly de-
soribed in accordance with the prOVisions of the contraot and the
oontraot documents, and that notlce of completion should be filed
and payment of the balance due said contractor authorized in accord-
ance with the contract documentso

NOW D THEREFORE, BE IT RESOLVED by the City Counc1l of the
City of Anaheim that all plant, labor, services, materials and
equipment and all utilities and transportation, and the performance
of all work necessary to construct, install and complete, in a good
and workmanlike manner, in strict acoordanoe with the speoifioa-
tions, plans and drawings therefor on file in the Office of the City
Clerk of the City of Anaheim, together with the appurtenanoes
thereto. said public improvement hereinabove more partiou1arly de-
scribed and set forth, in the City of Anaheim, by said oontractor,
be, and the same are hereby accepted. subject. nevertheless, to all
the terms, conditions and provisions of the contraot doouments, and
that the balance due said contraotor for said work be paid to it
thirty-five (35) days from and after final acceptance of said work
as evidenced by the adoption of this resolution, but not sooner than
thirty (30) days after the date of the filing of notice of com-
pletion. excepting only such sum or sums as may lawfully be withheld
1n accordanoe with the provisions of said contract and contract
documents. That acceptance by the contraotor of said payments made
in accordance with said final estimate shall operate and shall be a
release to the City of Anaheim, its officers. agents and employees
from all claims and liabilities due the contraotor for anything
done or furnished or withheld or fOr anything relating to the work
or any act or neglect of the City. its offioers, agents and em-
ployees. excepting only claims against the City fOr any amounts
withheld by the City at the time of such payment.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby authorized to
execute and file a notice of completion of said work as required
by law.
THE FOREGOING RESOLUTION is approved and signed by me
