59R-5351 ,"-'" RESOLUTION NO. 5351 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING WITHOUT PREJUDICE APPLICATION NO. F-58-59-l03 FOR A CHANGE OF ZONE IN A CERTAIN AREA OF THE CITY HEREINAFTER DESCRIBED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from persons in- terested therein; and WHEREAS, ~ithin a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings or facts and declare its opinions and reasons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 14th day of July, 1959 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opport- unity to be heard and did receive evidence and reports and did thereupon consider the recommendations of the City Planning Com- mission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone in ~hich it is now incor- porated, and that application No. F-58-59-103 for a change of zone should be denied without prejudice for presentation of a proper plan of drainage and street development of the area between S~inson Street and Magnolia Avenue; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, des- cribed as follows, to wit: That portion of the West 150.00 feet of the East 898.00 feet of the north half of the northeast quarter of the northeast quarter of section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, in the city of Anaheim, county of Orange, state of California, as said section is shown on a -1- { map recorded in beok 5l, page 11 of Miscellaneous Maps, in the office of the county recorder of said county, lying southerly of the following described line: Beginning at the intersection of a line parallel with and 748.00 feet westerly from the easterly line of said section 13, with the northwesterly line of the strip of land 70 feet in width described as Parcel Bl-701 in Case No. 73181 in the Superior Court of the State of California, in and for the County of Orange, the notice of action in said case having been recorded July 11, 1957 in book 3976, page 365 of Official Records, said intersection being South 0028110" East 121.11 feet along said parallel line from the northerly line of said section 13; thence South 0036'16" East 12.74 feeti thence South 5.0~toOft West 12.99 feet; thence South 15 17108" ~est 14.24 feet; thence Soulh 15051117" West 20.91 feet; thence South 89025110"West 1.13 feet to said:.northwester1y line of said 70 foot strip described as Parcel Bl-10l being on a curve con- cave north~esterly and having a radius of 150.00 feet a radial line from said point bearing North 10.36'57" West; thence southwesterly along said curve to the ~est line of said East 898.00 feet. remain in the R-A, RESlDENTIAL-AGRlaJL'lURAL ZONE in which it is no~ incorporated, and that the reclassification to R-3, MULTIPLE- FAMILY RESIDENTIAL ZONE be denied without prejudice, to permit refiling and presentation of plans for street development and drainage of the area bet~een Stinson Street and Magnolia Avenue. BE IT FURTHER RESOLVED that upon the refiling of said application for a change of zone, the required fee of $50.00 be waived.
