RESOLUTION NO. 5340
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM FINDING AND DETERMINING THAT PUBLIC CON-
VENIENCE AND NECESSITY REQUIRE THE CONSTRUCTION
AND COMPLETION OF A PUBLIC IMPROVEMENT, TO WIT:

AND APPROVING ~H~ DESIGNS, PLANS~ PROFILES,
DRAWINGS AND SPECIFICATIONS FOR TEE CONSTRUCTION
THEREOF; AUTHORIZING THE CONSTRUCTION OF SAID
PUBLIC IMPROVEMENT IN ACCORDANCE WITH SAID PLANS,
SPECIFICATIONS, ETC.; AND AUTHORIZING AND DIRECT-
ING THE CITY CLERK TO PUBLISH A NOTICE INVITING
SEALED PROPOSALS FOR THE CONSTRUCTION THEREOF.
WHEREAS. public convenience and necessity require the con-
struction and completion of a public improvement in the City of Ana-
heim, to wit:
The Iaprovement of Knott Avenue, from Lincoln Avenue
to Ball Road, by excavation, construction of 4-inch
plant-mix 8ur~acing, removal of curb and gutter, con-
struction of coacrete curb and gutter, removal o~
sidewalk, oonstruction of sidewalk aad construction
o~ standard concrete oommercial driveway, remodeling
driveway, installation o~ paddle boards, adjusting
existing manholes to grade, construction of plant-mix
bel', oonstruotion of plant-mix ourb, and appurtenant
york, as indicated on the plans, Project No. 72.
AND WHEREAS, the City Council instructed Thornton E. Piersall,
City Jagineer. to prepare detailed designs, plans, profiles,
drawings and specifications, and estimates of quantities and costs
and make necessary surveys for the construction of said public im-
provement; and
WHEREAS, said ~ineer has prepared said detailed de-
signs, plans, profiles, rawings and specifications for the construc-
tion of said public improvement and has submitted the same to the City
Council; and
WHEREAS, the City Council finds that the detailed designs,
plans, profiles, drawings and specifications for said public improve-
ment above-mentioned are in accordance with good engineering practice
and are adequate to serve the needs and requirements of the City of
Anaheim and the citizens and residents in said area for the purposes
~ for which they are intended. and that they are adequate for the con-
struction of said public improvement and should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the detailed designs, plans, profiles, drawings
and specifications for said public improvement hereinabove mentioned
and described be. and the same are hereby, approved and adopted as
prepared by said City Rn#1ueer

AND BE IT FURTHER RESOLVED that said public improvement
shall be constructed in accordance with said detailed designs,
plans, proriles, drawings and specirications as prepared by said
~.1aeer and hereby approved, and such addenda or
mo cations thereto as may be approved prior to the awarding or
bids thereror.
BE IT FURTHER RESOLVED that the City Clerk of the City
or Anaheim be, and she is hereby, authorized and directed to pub-
lish a notice according to law, inviting sealed proposals ror the
rurnishing of all plant, labor, services, materials and equipment,
and all utilities and transportation, including power, fuel and
water, and performing all work necessary to construct and complete,
in a good and workmanlike manner, in strict accordance with said
detailed designs, plans, proriles, drawings and specifications as
prepared by said City ~n..r , the public improvement
hereinabove mentioned an escribed, and rixing the 30th day or
July , 195~, at the hour of 2:00 o'clock P.M. as the date
and hour ror the opening or said bids at the City Council Chamber
in the City Hall in the City or Anaheim, and that said notice shall
be published twice, the rirst of which publications shall be at
least ten (10) days prior to the date rixed for the opening of bids,
and that said publications shall be at least rive (5) days apart.
AND BE IT FURTHER RESOLVED that the successful bidder or
bidders shall be required to enter into a contract with the City
of Anaheim in the manner and rorm approved by the City Attorney of
the City or Anaheim ror the construction, installation and comple-
tion or said public improvement hereinabove mentioned and described,
in accordance with the plans and specirications prepared by said
C1ti Bn.i~eel ' the notice inviting sealed proposals, this reso-
fut on an a 1 applicable City Ordinances or Code Sections and the
laws or the State or Calirornia, and shall be required to post bonds
and insurance in the amounts and within the time required by law,
as speciried in the notice inviting sealed proposals, and in a rorm
approved by the City Attorney.
THE FOREGOING RESOLUTION was approved and signed by me this
