59R-5334 .,.,-- RESOLUTION NO. 5334 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1111. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from the property owner and/or purchaser of certain real property situ- ated in the City of Anaheim, County of Orange, State of Cali- fornia, described as follows: PARCEL 1: The East one-half of the Southwest quarter of the Northeast quarter of Section 22, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, County of Orange, State of California, as shown on a map thereof recorded in Book 51, Page 11, Miscellaneous Maps, records of said Orange County. PARCEL 2: The Southeast quarter of the Northwest quarter of the Northeast quarter of Section 22, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, County of Orange, State of California, as shown on a map thereof recorded in Book 51, Page 11, Miscellaneous Maps, records of said Orange County. PARCEL 3: The East one-half of the Northeast quarter of the Northwest quarter of the Northeast quarter of Section 22, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, County of Orange, State of California, as shown on a map thereof recorded in Book 51, Page 11, Miscellaneous Maps, records of said Orange County. PARCEL 4: The Northwest quarter of the Southeast quarter of the Northeast quarter of Section 22, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, County of Orange, State of California, as shown on a map thereof recorded in Book 51, Page ll, Miscellaneous Maps, records of said Orange County. PARCEL 5: The West one-half of the Northeast quarter of the Northeast quarter of Section 22, in Township 4 South, Range II West, in the Rancho Los Coyotes, County of Orange, State of California, as shown on a map thereof recorded in Book 51, Page 11, Miscellaneous Maps, records of said Orange County; EXCEPTING THEREFROM the North 180 feet of the East 239.30 feet thereof (said 180 feet being measured to the center line of Ball Road). ,..c''''--'', AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on May 18, 1959, notices of which said public hearing ~ere duly given as required by law and the provisions of Section 9200.l7 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 224 -- Series 1958-59, recommending to the City Council of the City of Anaheim that Variance No. 1111 be denied; and -1- -, .-." WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission denying said variance, and said appeal was set for public hearing on June 16, 1959, at 7:00 o'clock P.M. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Sectiqn 9200.17 of the Anaheim Municipal Code; and WHEREAS, said hearing was duly held on June 16, 1959 and was thereupon contin~ed to a later date; and WHEREAS, the Ci~y Council does find that: l. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use or the. property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preser- vation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. L~. That the grant ing of such var iance will not ad- versely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to STANDARD DEVELOPMENT CORP., 8692 Wilshire Boulevard, Beverly Hills, California, permitting a ~aiver of the minilnum lot size and floor area requirements to allow construction of single-family dwellings of not less than 1,000 square feet livable floor area, with two car garages, on lots of not less than 6,000 square feet in area, ~ith a minimum front yard setback of 20 feet, on the property hereinabove de- scribed, with the exception of Lots 13 to 38, 267 to 279 and 165 to l89, which shall meet the minimum requirements of 7,200 square feet lot area and 1,225 square feet livable floor area, and on which no waiver is granted. -=-.. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim MUnicipal Code unless otherwise specified herein.
