A RESOL'U1'IOI OF THE CITY COUlfCIL OF TIlE
CITY OF UAHEIM Dl51UJ.JIG VARIANCE NO. 1122.
WWRR~AS, the City Planning Commission or the City or
Anaheim did receive a petition for zoning variance from Wayne
~arl Shull, Authori%ed Agent or the purehasers or certain real
property situated in the City or Anaheim, County of Orange,
State or Calirornia, described as follows:
'l'h.at portion of Lot 5 of Block 17 of a Subdivi-
sion or the South half of Section 21, Township
4 South, Range 10 West, S.B.B.c!c M., as shown on
a map recorded in Book 1, Page 33 of Miscellaneous
Maps, Records of Orange County, Calirornia, a
portion of said Lot 5 also being shown on a map of
Tract No. 2177, recorded in Book 59, Pages 36 and
37 of Miscellaneous Maps, Records of Orange County,
California, described as follows:
Beginning at the Northwest corner of the Southerly
260.00 feet of said Lot 5; thence South 89041t50"
East 255.01 feet parallel with the Southerly line
of said Lot 5 to a line parallel with and distant
Easterly 255.00 feet, measured at right angles,
from the Westerly line of said Lot 5; thence North
0055'00" East 102.26 feet along said parallel line
to the Southerly line of Lot 21 of said Tract No.
2177; thence North 89033'~3. West 255.01 feet
along said Southerly line and its Westerly prolonga-
tion to the Westerly line of said Lot 5; thence
South 0055'00" West 102.85 feet to the point of
beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City or Anaheim on June
2, 1959, notioes of which said public hearing were duly given as
required by law and the provisions of Section 9200.17 of the
Anaheim Municipal Code; and
~EAS, said City PlAnning Commission, after due in-
spection, investigations and studies made by itself and in its
behalf, and atter due consideration of all evidence and reports
orfered at said hearing, did adopt Resolution No. 245, Series
1958-59, denying Variance No. 1122; and
WHEREA.S, thereafter, within twenty (20) days rrom the
date of the adoption of said resolution, a written appeal was
fl1ed with the City Counci1 of the C~t7 of Anahe~ protesting
the action of the City Planning Commission in denying said variance,
and said appeal was set tor public hearing on the 7th day of July,
1959, at 7:00 otclock P. M. at the City Xal1 in the City of Anaheim,
and notice of such pUblic hearing was duly given as required by law
and the provisions of Section 9200.17 of the Anaheim Municipal Code;
and

WHEREAS. after due investigation and studies made by
itaelr and in its behalf, and after due eonaideration of all evi.
dence and reports oftered at said hearing, the City Council does

1. There ia no substantial property right
poasessed by other property in the same
vicinity and zone and denied the subject
property.
2. It appears that the subject property can
be adequately developed and used under
the present zone.
NOW, 'l'RUEFORE, BE IT RESOLVED by the City Council of
the City of Anahe~ that the action or the City Planning Commis-
sion denying Petition for Variance No. 1122, requesting permis-
sion to build professional offices, retail stores and a cocktail
bar on the property hereinabove described, be sustained, and that
Variance No. 1122 be, and the same is hereby, denied.

adopted at an adjourned regular meeting of the City Counoil .eld
on the 7th day of July, 1959, by the following vote of the members
thereof:
AYES: COUNCILMEN: Borden, Fry, Pearson and
Schutte.
NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: Coons.
AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said resolution on the 7th day of
July, 1959.
