59R-5330 - RESOLUTION NO. 5330 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE (NO. 1114). /""" WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from the prop- erty owner and/or rurch~a~r of certain real prop- erty situated in the City 0 Ana eim, County of Orange, State of California, described as follows: Lot One of Tract No. 1948 as shown on a map recorded in Book 58, pages 41, 42 and 43 of Miscellaneous Maps, reoords of Orange County, Cali1'ornia. AND WHEREAS, the City Planning Commission did hold a pub- lic h~~ring at the City Hall in the City 01' Anaheim upon said peti- tion on June 2. 1159 , notices of which said publio hearing were duly g ven as required by law and the provisions of Section 9200017 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investiga- tion and studies made by itself and in its behalf and a1'ter due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 23~ ,recommending to the City Coun- cil of the City of Anaheim that ariance No. 1114 be granted upon the conditions stated in said resolution; and WHEREAS. the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. ~ 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to MARTIN SORKIN, 1180 North Los Angeles Street, Anaheim, California, to use the existing dwelling located on the property hereinabove described for an accounting office, sub- ject to the following conditions: -1- 1. That the owner 01 subject propert;'l deed to tue City of' Anaheim a strip of land 53 f'eet in widtll, from the center line of' the street, along Magnolia Avenue :for street widening purposes. - 2. That the owner of' subject property pay to the City of Anaheim the sum of $2.00 per f'ront foot :for street lighting purposes. 3. That the f'ront yard of said lot be maintained in a condition similar to the front yards of other residences in the area. 4. That an improved parking area be provided as shown on the plot plan this day submitted to the City Council and on file with the City of Anaheim. 5. That any changes to the exterior of the house shall be limited to changes which will not aff'ect the present residential character of the house. 6. That the maximum size of any sign on subject property shall be 8" x 12". - The City Council hereby reserves the right to revoke such variance permit for good cause or failure of' said owner , his heirs, IUCcessors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwi.e specif'ied herein.
