RESOLUTION NO. 5294
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING RESOLUTION NO. 5276 IN
RECLASSIFICATION PROCEEDINGS NO. F-58-59-84.
WHEREAS, the City Council of the City of Anaheim did
heretofore, to wit, on June 2, 1959, adopt Resolution No. 5276
in Reclassification proceedings No. F-58-59-84 changing the
property therein described from R-A, Residential-Agricultural
Zone to C-2, General-Commercial Zone, subject to certain con-
ditions set forth in said resolution; and
WHEREAS, Condition No. 1 of said resolution reads
as follows:
"1. That the owner of subject property place of
record standard City of Anaheim C-2 Deed Re-
strictions, approved by the City Attorney, which
restrictions shall limit the use of the property
to a nursery only."
AND WHEREAS, the City Council finds that the uses of
the property should be limited specifically to a nursery, or
administrative and professional uses, and that Condition No. 1
of Resolution No. 5276 should, therefore, be amended; and
WHEREAS, the City Council does further find that an
ordinance has never been adopted directing said change of zone
and completing said proceedings;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Condition No.1 of Resolution No. 5276,
adopted June 2, 1959, be amended to read as follows:
"1. That the owner of subject property place of record
standard City of Anaheim C-2 Deed Restrictions,
approved by the City Attorney, which restrictions
shall limit the uses of the property specifically
to a nursery, or administrative and professional
uses."
BE IT FURTHER RESOLVED that in all other respects said
Resolution No. 5276 be, and remain in full force and effect.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an amendment to Article IX, Chapter 2 of the
Anaheim Municipal Code to amend said Anaheim Municipal Code to
accomplish the object herein found and determined to be necessary
and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 16th day of June, 1959.
