A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM MODIFYING THE RATES, RULES AND
REGULATIONS, WHICH DO NOT MATERIALLY INCREASE
RATE -RELATED REVENUES, FOR THE SALE AND
DISTRIBUTION OF WATER AS ADOPTED BY RESOLUTION
NO. 72R-600 AND MOST RECENTLY AMENDED BY
RESOLUTION NO. 2023-023 AND DETERMINING THAT
SAID ACTIONS ARE EXEMPT FROM THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO
PUBLIC RESOURCES CODE SECTION 21080(B)(8) AND
SECTIONS 15061(B)(3) AND 15273(A) OF TITLE 14 OF THE
CALIFORNIA CODE OF REGULATIONS.
WHEREAS, the City of Anaheim ("Anaheim") maintains a water production,
transmission, and distribution system for the distribution of water to residents and businesses of
Anaheim and has adopted Water Rates, Rules and Regulations for the sale and distribution of
water; and
WHEREAS, the Anaheim Municipal Code authorizes the City Council of Anaheim
("Anaheim City Council") to approve reasonable Water Rates, Rules and Regulations for the
recovery of costs of water services, which are provided by the Anaheim Public Utilities
Department ("APU"); and
WHEREAS, APU is a publicly owned utility that and continuously seeks
opportunities to minimize administrative and fiscal burdens while remaining in a position to
maintain service reliability and high industry standards; and
WHEREAS, in support of the foregoing, APU staff reviewed and recommends (1)
the adoption of modifications to Schedule W-CA, Schedule W-SRA, Schedule W-G, and Schedule
W-PFL of the Water Rates, Rules and Regulations, as set forth in Attachment A and (2)
modifications to Rule No. 26 of the Water Rates, Rules and Regulations, as set forth in Attachment
B; and
WHEREAS, in accordance with Article XIIID of the California Constitution, on
January 9, 2024, Anaheim mailed a Notice of Public Hearing to property owners of record within
the City of Anaheim as of October 27, 2023 (the most current tax roll data available), and Water
Utility customers of record as of October 20, 2023, providing an explanation of the proposed
modifications to Schedule W-CA, Schedule W-SRA, Schedule W-G, and Schedule W-PFL, and
the procedure for submitting written protests of the proposed rate action to the Secretary of the
Public Utilities Board as well as electronic mail ("e-mail") protests at waterrates(4�anaheim.net;
and
WHEREAS, on February 8, 2024, and February 15, 2024, notice of the public
hearing regarding modifications to the water rate schedules of the Water Rates, Rules and
Regulations was published in the Anaheim Bulletin, and proof thereof is on file with the Secretary
of the Public Utilities Board; and
WHEREAS, on February 12, 2024, and February 19, 2024, notice of the public
hearing regarding modifications to the water rate schedules of the Water Rates, Rules and
Regulations was published in the Orange County Register, and proof thereof is on file with the
Secretary of the Public Utilities Board; and
WHEREAS, the Public Utilities Board held a public hearing for the water rate
schedule and rule modifications on February 28, 2024, and evidence was presented in support of
the modifications to the Water Rates, Rules and Regulations; and
WHEREAS, the Public Utilities Board considered the proposals of APU and
considered the evidence presented at the public hearing; and
WHEREAS, the Public Utilities Board made the following findings with respect to
the need for the proposed rate modifications to the Water Rates, Rules and Regulations:
1. Section 1221 of the City Charter provides that utility rates charged to a class
of customers shall be uniform within the class and shall be based on the cost of
service revenue requirement for the class.
2. Section 1221 of the City Charter requires that utility rates shall be sufficient
in order to allow the utility to pay for operations and maintenance of the system;
for payment of principal and interest on debt; for creation and maintenance of
financial reserves adequate to assure debt service on bonds outstanding; for capital
construction of new facilities and improvements of existing facilities, or
maintenance of a reserve fund for that purpose; and for payments to the general
fund of the City in the amounts set forth in the City Charter.
3. Section 1221 of the City Charter also provides that the Anaheim City
Council shall periodically review rates to insure that financial goals are being
accomplished.
4. In setting rates, it is reasonable and appropriate to recognize the benefits
that APU customers will realize through having rates for domestic and non -
domestic customers remain competitive with other local providers.
5. It is reasonable and appropriate to make modifications to: (1) Schedule W-
G and Schedule W-PFL to better align APU's fixed-rate water charges with its fixed
water costs; (2) Schedule W-CA to add a Water Regulatory Adjustment to recover
the cost of complying with future mandates on water use efficiency, drought
resilience, and other related measures that are not currently covered in the existing
rate schedule; and (3) Schedule W-SRA to increase the authorized maximum
allowed annual increase and redefine the capital reserve account limit to help ensure
rate stability in the event of a recession.

6. As supported by the evidence presented to the Public Utilities Board at the
public hearing, the proposed modifications to Schedule W-CA, Schedule W-SRA,
Schedule W-G, and Schedule W-PFL of the Water, Rates, Rules and Regulations
comply with the substantive requirements of Article XIIID, section 6 of the
California Constitution, including that (1) revenues derived from the proposed
modifications shall not exceed the funds required to provide water service; (2)
revenues derived from the proposed modifications shall not be used for any purpose
other than that for which it is charged; (3) the proposed Schedule W-CA, Schedule
W-SRA, Schedule W-G, and Schedule W-PFL do not exceed the proportional cost
of the water service attributable to any parcel; (4) Schedule W-CA, Schedule W-
SRA, Schedule W-G, and Schedule W-PFL are only imposed when water service
is actually used or immediately available and is not imposed for general
governmental services.
WHEREAS, it is reasonable and appropriate to modify Rule No. 26, which pertains
to the water discount program currently in place for income -qualified senior, long-term disabled,
and military veteran customers, to increase the discount on water charges; and
WHEREAS, the Public Utilities Board considered the requirements of the
California Environmental Quality Act (CEQA) and found that the proposed modifications to the
water rate schedules and rules, as set forth in Attachment A and Attachment B, come within Public
Resources Code section 21080(b)(8) and Title 14 of the California Code of Regulations, sections
15061(b)(3) and 15273(a). Thus, these modifications are exempt from CEQA; and
WHEREAS, based on the findings hereinabove made and the public hearing record,
the Public Utilities Board recommended that the Anaheim City Council determine that the
modifications to the Water Rates, Rules and Regulations are exempt under CEQA, Public
Resources Code section 21080(b)(8) and Title 14 of the California Code of Regulations, sections
15061(b)(3) and 15273(a); and
WHEREAS, based on the findings hereinabove made and the public hearing record,
the Public Utilities Board recommended that the Anaheim City Council adopt the findings of the
Public Utilities Board with respect to the matters contained herein and adopt the modifications to
the Water Rates, Rules and Regulations as set forth in Attachment A and Attachment B, which are
on file with the Office of the City Clerk; and
WHEREAS, the Anaheim City Council has considered the evidence and concurs
with the findings of the Public Utilities Board as set forth hereinabove.
NOW, THEREFORE BE IT RESOLVED by the Anaheim City Council as follows:
1. The findings set forth herein are hereby adopted by the Anaheim City
Council.
2. The Anaheim City Council hereby determines that, in accordance with
CEQA and the State CEQA Guidelines, the modifications to the water rate schedules and rules of
the Water Rates, Rules and Regulations, as set forth in Attachment A and Attachment B, are
exempt from CEQA pursuant to Public Resources Code section 21080(b)(8) and sections

15061(b)(3) and 15273(a) of Title 14 of the California Code of Regulations because it can be seen
with certainty that there is no possibility that the proposed modifications will have a significant
effect on the environment and the modifications are designed to recover costs and are
administrative in nature.
3. The Anaheim City Council hereby adopts the modifications to the Water
Rates, Rules and Regulations, as set forth in Attachment A and Attachment B. These modifications
shall be effective April 3, 2024.
4. The Anaheim Public Utilities General Manager is hereby authorized and
directed to prepare, promulgate, publish, and implement changes to the Water Rates, Rules and
Regulations as set forth herein.

A. APPLICABILITY

Applicable to all areas served by the Utility and to all rate schedule commodity charges.
B. PURPOSE
To provide for the automatic adjustment of the Utility's water rate schedule commodity charges per
100 cubic feet whenever the cost per acre foot (A.F.) of water is increased due to changes in the
Orange County Water District (OCWD) pump tax and basin equity assessment; the Metropolitan
Water District of Southern California (MWD) acre foot charge for treated and untreated water; fixed
charges, such as a readiness charge, a connection charge, or a demand charge; and/or the costs of
electricity associated with producing and distributing water.
To provide for the automatic adjustment of the Utility's water rate schedule commodity charges per
100 cubic feet to recover expenditures made or proposed within a designated time period, not to
exceed one year, to accommodate Federal and/or State mandated rules and regulations pertaining to
water quality.
To establish the method for determining the cost of water per acre foot and any resulting change to
the rate schedule commodity charges (expressed to the nearest $0.001 per 100 cubic feet).
C. COST OF PRODUCING AND DISTRIBUTING WATER
The cost of water shall be the sum of the percent of groundwater times its total cost per A.F. plus the
percent of water purchased times its total costs per A.F. (including appropriate fixed charges). The
total cost per A.F. of groundwater is the sum of the OCWD pump tax plus the cost of electricity to
pump water per A.F. The total cost per A.F. of purchased water is the MWD price per A.F. for treated
or untreated water (including appropriate fixed charges). The cost of distributing water shall include
the cost of electricity for the booster pumps.
D. AMOUNT OF ADJUSTMENT
Previously, the commodity adjustment calculation included an adjustment for the base year 1971-72
cost of water. Effective September 1, 1996, the calculation methodology shall remain the same in all
respects with the exception of the base -year calculation. The calculation shall not include a base -year
adjustment.
Effective September 1, 1995, the Agricultural Customer Class is combined with the General
Commercial/Industrial Customer Class, thereby eliminating the Agricultural Commodity
Adjustment.
The percent of groundwater to be pumped and imported water to be purchased (including fixed
charges) established as of July 1 each fiscal year shall apply in any commodity adjustment
computation throughout that fiscal year.
The amount of the commodity adjustment and the data elements required to compute the commodity
adjustment for the most recent changes shall be shown in the COMMODITY ADJUSTMENT
SUMMARY section below.

The cost of the Water Quality Adjustment shall be calculated in accordance with the following

(b) An amount equal to five percent (5%) of (a) immediately above.
(c) Water Quality Improvement Adjustment Account ending balance.
(d) The total estimated water sales for a designated period.
A Water Quality Adjustment Account shall be maintained by the Department. Entries to this account
shall include:
(a) An amount equal to water quality expenditures as recorded during the month.
(b) Less: An amount equal to revenue billed during the time period that is attributable
to the Water Quality Adjustment.
F. COST OF WATER REGULATORY ADJUSTMENT
The cost of the Water Regulatory Adjustment shall be calculated in accordance with the following
formula.

G. APPLICATION OF COMMODITY ADJUSTMENT
The commodity charge for all rate schedules shall be adjusted as necessary by the Utilities General
Manager to reflect the cost per A.F. of water at that time and to reflect mandated expenditures for
water quality improvements. The increased cost of water shall be rounded to the nearest $0.001 per
100 cubic feet and added to the commodity charge for each rate block of each water schedule rate
charge.

SCHEDULE W-SRA
WATER SYSTEM RELIABILITY ADJUSTMENT
APPLICABILITY
Applicable to all areas served by the Utility and to all water Rate Schedule commodity charges.
PURPOSE
To provide for the automatic adjustment of the Utility's water Rate Schedule commodity charges per hundred
cubic feet through the Water System Reliability Adjustment ("Water System Reliability Adjustment" or
"WSRA") for the purpose of recovering projected capital costs, including rehabilitation and construction of
water and reclaimed water system infrastructure, and related debt service payments for the Utility. The WSRA
will also fund a Capital Reserve Account ("Capital Reserve Account").
CALCULATION OF WATER SYSTEM RELIABILITY ADJUSTMENT
For rate adjustments occurring on or after July 1, 2019, the amount of the Water System Reliability
Adjustment shall be calculated in accordance with the following formula.

(a) Expenditures for the Water Utility's capital improvement program less those funded by
developer contributions or other contributions, as reflected in the annual budget adopted by
the City Council.
(b) Capital Reserve Account limit, not to exceed the highest of the three most recent fiscal year
Water Utility capital improvement program budgets adopted by the City Council.
(c) Capital Reserve Account balance as of the end of the previous fiscal year.
(d) Bond funds allocated for capital expenditures.
(e) Funds available in the Water System Reliability Adjustment Balancing Account.
(f) Projected Water Utility debt service payments for the fiscal year.
(g) Projected water sales for the fiscal year.
APPLICATION OF WATER SYSTEM RELIABILITY ADJUSTMENT
The Water System Reliability Adjustment shall be adjusted by the General Manager to reflect non -
reimbursable capital infrastructure and debt service costs, including costs associated with reclaimed water
infrastructure, as adopted by the City Council in the annual budget, and to fund a Capital Reserve Account to
be used for those purposes. The Water System Reliability Adjustment shall be limited to a maximum increase
of 10¢ per hundred cubic feet (HCF) of water consumed per 12-month period ("period"); there shall be no
limit on decreases to the Water System Reliability Adjustment.
The Utility shall establish a designated Water System Reliability Adjustment Balancing Account ("Water
System Reliability Adjustment Balancing Account") to account for these collections and uses of funds. The
funds accounted for in the Water System Reliability Adjustment Balancing Account shall only be used to pay
for the capital improvement program as set forth in the formula above.

period shall be transferred to the Capital Reserve Account subject to the Capital Reserve Account limit set

The Utility shall establish a restricted water Capital Reserve Account to be used solely to pay for non -
reimbursable capital infrastructure and debt service costs, including costs associated with reclaimed water
infrastructure. The Capital Reserve Account limit shall not exceed the highest of the three most recent fiscal
year Water Utility capital improvement program budgets approved by the City Council.

The Utility offers programs in the areas of water efficiency and low-income assistance. In connection with the
foregoing, this Rule outlines water bill assistance for income -qualified Customers.
A. WATER DISCOUNT FOR INCOME -QUALIFIED SENIOR, LONG-TERM DISABLED, OR MILITARY
VETERAN CUSTOMERS
The Income -Qualified Senior/Long-Term Disabled/Military Veteran Water Discount Program provides a
12% discount on residential water charges for income -qualified senior, long-term disabled, and military
veteran Customers, as set forth in Sections A.1 and A.4. This Program remains in effect until terminated by
the City Council.
Qualifications
To receive the assistance as an income -qualified senior Customer, the following guidelines must be
met:
a. Have an annual household income level of 80% or less of the Orange County median, according
to the annual Housing and Urban Development Section 8 income guidelines.
b. Be at least 62 years of age as demonstrated by submitting a copy of State -issued identification.
c. Be a residential Customer of record or Sub -metered master -metered Customer.
To receive the assistance as an income -qualified long-term disabled Customer, the following
guidelines must be met:
a. Have an annual household income level of 80% or less of the Orange County median, according
to the annual Housing and Urban Development Section 8 income guidelines.
b. Submit to the Utility Social Security Supplement to Income (SSI) documentation or a letter
from a licensed physician.
c. Be a residential Customer of record or Sub -metered master -metered Customer.
To receive the assistance as an income -qualified military veteran Customer, the following guidelines
must be met:
a. Have an annual household income level of 80% or less of the Orange County median, according
to the annual Housing and Urban Development Section 8 income guidelines.
b. Submit to the Utility identification establishing military service such as a copy of a
DD-214, Veteran Health Identification Card (VHIC), or Common Access Card (CAC).
c. Be a residential Customer of record or Sub -metered master -metered Customer.
Adjustment of Water Bills
Income -qualified senior, long-term disabled, and military veteran residential water Customers will
receive a twelve percent (12%) discount applied to the water charges on their bills. For the purpose
of this Rule, these water charges include the Customer Charge, Commodity Charge, Schedule W-
CA charge, and Schedule W-SRA charge. The discount shall appear as a line item on the Customer's
bill. The discount shall be calculated separately for each Customer who is individually metered by
the Utility, based upon the water charges.
Master -metered Customers who provide water Sub -metering to qualified tenants are also eligible
for the water discount. The master -metered Customer shall be issued a flat discount amount equal
to $10 per month. This will be multiplied by the number of income -qualified senior, long-term
disabled, and military veteran tenants who are Sub -metered to the master meter.

Termination of Billing Discount
Once instituted, the discount shall remain in effect until any one of the following occurs:
1. The annual household income of the income -qualifying senior, long-term disabled, or military
veteran person exceeds 80% of the Orange County median, according to the annual Housing
and Urban Development Section 8 income guidelines.
2. For individually metered accounts, the income -qualifying senior, long-term disabled, or
military veteran person is no longer named on the Customer account.
3. For master -metered accounts, the income -qualifying senior, long-term disabled, or military
veteran person is no longer named as the tenant.
4. The Customer is found responsible for tampering with or theft of Utility service or
infrastructure.
5. Funds allocated to the program are exhausted.
6. The Income -Qualified Senior/Long-term Disabled/Military Veteran Water Discount Program
is terminated by the City Council.
Billing Discount
1. Income -qualified senior, long-term disabled, and military veteran Customers who are
individually metered by the Utility will receive a twelve percent (12%) discount applied to the
water charges on their bills, including the Customer Charge, Commodity Charge, Schedule W-
CA charge, and Schedule W-SRA charge, as shown in the following formula:
(Customer Charge + Commodity Charge + WCA + WSRA) X .12 = Water Discount
2. Master -Metered Customers
a. Master -metered Customers who provide water Sub -metering and issue water bills to their
tenants shall be issued a flat monthly discount for their income -qualifying senior, long-
term disabled, and military veteran tenants using the following formula:
Number of income -qualified senior, long-term disabled, and military veteran tenants X $10
= Water Discount
The master -metered Customer shall pass this savings directly on to the income -qualified
senior, long-term disabled, and military veteran tenants.
b. The master -metered Customer shall maintain records of proof of payment of Customer
credits to qualified tenants. The records of proof of payment of Customer credits to
qualified tenants are subject to periodic review and audit by the Utility. Credits that are
misappropriated are subject to recapture on the master -metered Customer bill by the
Utility.

Emergency Water Utility bill payment assistance is offered by the Utility to income -qualified residents,
subject to available funding. Customer service representatives will provide information regarding emergency
Water Utility bill payment assistance, including the application process. Customers approved for emergency
Water Utility bill payment assistance receive assistance in the form of a bill credit applied to the water charges
portion of the bills.
C. THIRD PARTY FINANCIAL ASSISTANCE
Customers who are experiencing financial difficulty may qualify for Water Utility bill payment assistance
from a third -party local, state, or federal agency. The Utility is not directly affiliated with these agencies but
provides a list of such agencies on its website. Assistance from these agencies is subject to Customers'
meeting the agencies' eligibility requirements and is dependent upon available funding. Payments received
by the Utility from such agencies, on behalf of the Customer, shall be applied to the water charges portion of
the Customer's Utility bill.
