66-640RESOLUTION NO. 66R -640 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 878 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from BILL ASAWA, 720 South Beach Boulevard, Anaheim, California, to establish a motorcycle sales and service agency on the follow- ing described property situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of the southwest quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as per map recorded in book 51, page 11 of Miscellaneous Maps, in the office of the County Recorder of said County. Beginning at a point on the West line of said Section, South 0° 10' 30" West 1019.96 feet from the west quarter corner of said section; thence South 0° 10' 30" West 133.65 feet; thence South 89° 49' 30" east 92.00 feet; thence southeasterly 39.35 feet along a curve tangent to a line parallel with said West line, concave northeasterly and having a radius of 25.00 feet; through an angle of 90° 10' 30 thence East 139.84 feet to the beginning of a curve concave northwesterly having a radius of 50.00 feet; thence north- easterly 32.18 feet along said curve through a central angle of 36° 52' 12" to the beginning of a reverse curve having a radius of 50.00 feet; thence easterly 78.54 feet along said curve through an angle of 90° 00' 00 thence East 10.09 feet to the West line of the land described in the deed to Eastland Savings and Loan Association, recorded July 23, 1962 in book 6186 page 318 of Official Records; thence North 0° 10' 15" East along said West line to a line parallel with the North line of said southwest quarter that passes through the point of beginning; thence West to the point of beginning. EXCEPT the West 92.00 feet thereof. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upor said application or Au ust 29 1,966 notices of which said public hearing were du y given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No,PC 66 66 gran Conditional Use Permit No 878 subiect to certain cond therein set forth ;and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said conditional use permit and did thereupon fix the 4th day of October 1966 as the time and the Council Camber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis ssion in ranting said conditional use permit be, and the same is hereby sustained and that Conditional Use Permit No. 878 be, and the same is hereby, granted permitting the establishment of a motorcycle sales and service agency on only that portion of the hereinbefore described real property presently projected for motorcycle sales and service, excluding therefrom the unpaved area to the east projected for drivers' education or any other use such as testing or racing, subject to the following conditions: 1. That this conditional use permit is granted subject to the completion of Reclassification Proceedings No. 66 -67 -15 now pending. 2. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1 and 2; provided, however, that the sign located in the northerly driveway approach shall be removed. 3. That the legal description of the property herein above described shall be amended to include only that portion thereof presently projected for motor- cycle sales and service, excluding therefrom the unpaved area to the east projected for drivers' education or any other use such as testing or racing. 4. That all storage of vehicles, other than for dis- play sales purposes, shall be inside a :wilding or behind a 6 -foot masonry wall. THE FOREGOING RESOLUTION is approved and signed by me this 4th day of October, 1966.
