RESOLUTION NO. 5283

A RESOLUTION OF THE CITY COUNC IL OF THE CITY OF
ANAHEIM RESCINDING RESOLUTION NO. 5145 IN RE-
CLASSIFICATION 1"-58-59-65 AND REFERRING THE
MATTER BACK TO THE CITY PLANNING COMMISSION FOR
FURTHER HEARING.
WHEREAS, the City Council having heretofore adopted
Resolution No. 5145 in the above entitled matter, approving
said reclassification as therein specified; and
WHEREAS, it now appear ing to the Ci ty Counci 1 that
the description of the property proposed to be rezoned as
furnished to the City Planning Commission is erroneous and
does not properly describe the property owned by the appli-
cant and which he seeks to have rezoned; and
WHEREAS, it appearing to the City Council that the
proceedings heretofore had are invalid by reason of the de-
fective description of the property and the failure of the
notice of the public hearing on said reclassification to
adequately describe the property, and that it is necessary
to refer said matter back to the Planning Commission for a
hearing upon proper notice; and
WHEREAS, since the applicant did not f~rnish the
City with a correct description of the property, he should
be required to pay an additional filing fee to cover the
costs of such rehearing;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Resolution No. 5145 in reclassifi-
cation proceedings No. F-58-59-65 be, and the same is hereby
rescinded; and that said matter be, and the same is hereby
referred to the Ci ty Planning Commission for fur.ther hearing
in accordance with the Anaheim Municipal Code.
AND BE IT FURTHER RESOLVED that the applicant be,
and he is hereby required to pay a new filing fee of $50.
THE FOREGOING RESOLUTION is approved and signed by
me this 9th day of June, 1959.
