59R-5274 -- ~..........., RESOLUTION NO. 5274 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM INITIATING PROCEEDINGS FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF ANAHEIM, ON ITS OWN MOTION; DESIGNATING THE TERRITORY AS THE ORANGE COUNTY WATER DISTRICT ANNEXATION ; DESORIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLAOE WHERE AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR BEFORE THE CITY OOUNCIL AND SHOW OAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF ANAHEIM. WHEREAS, the City Council of the City of Anaheim has in- vestigated certain uninhabited territory as hereinafter set forth and does find that such territory is so situated as to require facilities of the City of Anaheim to pass through such territory, and does find that such territory can be easily served with the facilities of the City of Anaheim and does further find that service of other areas in the City of Anaheim will be facilitated by annexation of such uninhabited territory, and that annexation of such territory will be in the best interest of the City of Anaheim and the best interest of the area to be annexed; and WHEREAS, the City Council does hereby determine that proceedings for the annexation of the hereinafter described uninhabited territory should be initiated by the City Oouncil on its own initiative; and WHEREAS, the proposal for the annexation of the terri- tory hereinafter described to the City of Anaheim was submitted to the Boundary Commission of the County of Orange, State of California, and reported upon by said Boundary Commission with respect to the definiteness and certainty of the proposed boundaries; and WHEREAS, said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of Oalifornia and is contiguous to the City of Anaheim and is uninhabited territory; and WHEREAS, the City Council finds from evidence and reports received that said new territory proposed to be annexed to said City of Anaheim does not form a part of any municipal corporation and that said territory is uninhabited and is con- tiguous to the City of Anaheim; and WHEREAS, the City Council finds that the boundaries of the territory SO proposed to be annexed to the City of Anaheim are as follows, to wit: - c -1- ORANGE COUNTY WATER DISTRICT ANNEXATION "_c That parcel of land located in the County of Orange, State of California, being a portion of Lot One, Block K of the Kraemer Tract, as shown on a map filed in Book 12, Pages 87 and 88 of Miscellaneous Maps, Records of Los Angeles County, California, and more particularly described as fol lows: 1. Beginning at the point of intersection of the west line of said Lot One, Block K of the Kraemer Tract, with the existing Anaheim City limits line as established by the Northeast Annexation No. 2-A to the City of Anaheim, passed by Ordinance No. 1269 on August 12, 1958, and fi led with the Secretary of State September 12, 1958, thence; 2. Northerly along the west line of Lot One, Block K of said Kraemer Tract a distance of 1,999.25 feet to a point, said point being the beginning of a curve concave southeasterly and having a radius of 340.00 feet; thence, 3. Northerly and easterly along said curve through a central angle of 1090 39' 06" an arc di stance of 650.69 feet to a poi nt in the southerly line of the Atchison, Topeka and Santa Fe Railroad right-of-way as conveyed to the Santa Fe Land Improvement Company by deed recorded March 31, 1910, fi led in Book 177, Page 392 of Deeds, records of Orange County, California; thence, 4. Southeasterly along the southerly right-of-way line of said Atchison, Topeka and S~nta Fe Railroad to the point of intersection with the east line of the west 77.28 acres of Lot One, Block K of said Kraemer Tract, said east line being established by a boundary line agreement between the Anaheim Union Water Company and the Orange County Water District, as des- cribed in Document No. 88414 recorded July 22, 1958, and fi led in Book 4357, Pages 330, 331, 332 records of Orange County, California; thence 5. Southerly along said east 1 ine of the west 77.28 acres of Lot One, Block K of said Kraemer Tract a distance of 1,527.14 feet to a point, said point being the beginning of a curve concave northwesterly and having a radius of 500.00 feet; thence, 6. Southerly and westerly along said curve through a central angle of 890 59' 54" an arc distance of 785.38 feet to the south I ine of Lot One, Block K of said Kraemer Tract; thence, -2- - ,......... 7. AND BE IT FURTHER RESOLVED that the City Council does find that the owner or owners of all of the territory proposed to be annexed have filed their consent to such annexatlon, in wrlting, with t1:1e City Council. AND BE IT FURTHER RESOLVED that the 14th day of Jul~ ' 19~. at the hour of 7:00 0 I clock -LM., at the ity Council Chambers in the City Hall of the City of Anaheim be, and the same is hereby, fixed as the day, hour and place when and where the City Council will hear protests made by any owner or owners of real property wi thin the territory l)ro- posed to be annexed; and that at any time before the haul' set for hearing objections, any owner of property wi thin said terl'itory may file with the City Clerk a written protest against the an- nexationo Said protest shall be in writing and shall state the name of the owner of the property affected and the descr:i.ptlon and area of the property in general terms. AND BE IT FURTHER RESOLVED that the City Olerk be. and she is hereby, authorized and directed to cause a copy of this ResolutiDn to be published at least twice, but not oftener than once a week, in a newspaper of general circulation, published in the City, to wit: thA AnAhAim GA7.At+... of Anaheim. Orange County, California. and also in a newspaper of general circulation, published outside of the City, but in the County of Orange, in which is located the territory hereinabove proposed to be annexed to the City of Anaheim, to wit: +'h"\l Dai ~y N9wa of 0.apt Ii' .. _.. Grove ,Orange County, California; an that such pu !lcation shall be completed at least twenty (20) days prior to the date of hear:i.ng hereinabove specified. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be. and she is hereby authorized and directed to cause wI'i tten notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be an- nexed is assessed, in the last equalized county assessment roll available, on the date the proceedings were initiated, at the address shown on said assessment roll al' as known to said City Clerk, and to any person who has filed his nBme and address and the designation of lands in which he has any interest, either ~ legal or equitable, with said C1Clrk; and in the e1rrmt that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, the City Clerk of the City of o,Lt_.. Anaheim shall also oause written notioe ot .uoh proposed annexa- tlon to be mal1ed to the Board ot Supervi80r. ot .uoh Oounty. The toregoing notioe. shall be given not less than twenty (20) -- days 'betore the t1rst publio hearing on the proposed annexatlon.
