RESOLUTION NO. 5267
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING RESOLUTION NO. 5169 GRANT-
ING SPECIAL USE PERMIT NO. 28 AND DEFERRING
THE INSTALLATION OF IMPROVEMENTS UNTIL REQUIRED
BY THE CITY ENGINEER.
WHEREAS, the City Council of the City Qf Anaheim did
heretofore, to wit, on April 21, 1959, adopt Resolution No.
5169 granting Special Use Permit No. 28 to Reverend James Heaps
to convert an existing warehous~ located on the premises de-
scribed in said resolution, for use as a church; and
WHEREAS, Conditions Nos. 3 and 4 of said resolution
read as fo 11 ows :
"3. That all engineering requirements of the City of
Anaheim, along Orange Avenue and Webster Street,
such as curbs and gutters, sidewalks, street
grading and paving, drainage facilities or other
pertinent work be complied with as required by
the City Engineer, and in accordance with plans
and specifications on file in the office of said
City Engineer.
"4. That the owner of subject property pay to the
City of Anaheim the sum of $2.00 per front foot
along Orange Avenue and Webster Street, for street
lighting purposes."
AND WHEREAS, a request has been received from Reverend
Heaps for reconsideration of the requirements along Webster Street,
and the City Council does find that the installation of street
improvements or engineering requirements on Webster Street should
be deferred until required by the City Engineer, and that the $2.00
per front foot charged for street lighting on Webster Street should
be refunded to Reverend Heaps or applied to other charges yet to
be paid; and that Resolution No. 5169 should, therefore, be amended
in these particulars;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Resolution No. 5169, adopted April 21,
1959, be amended as follows:
1. That all engineering requirements of the City of
Anaheim along Webster Street, such as curbs and
gutters, sidewalks, street grading and paving,
drainage facilities or other pertinent work, for
the following described property situated in the
City of Anaheim, County of Orange, State of Cali-
fornia:
Lot 20 of Tract No. 796, as shown on a map re-
corded in Book 24, Page 28 of Miscellaneous Maps,
Records of Orange County, California.
EXCEPT the interest in the West 30 feet of said
land which was conveyed to the County of Orange
for highway purposes by deed recorded December 17,
1937 in Book 918, Page 435, Official Records.

ALSO: Lot 21 of Tract No. 796, as shown on a map
recorded in Book 21+, Page 28 of Misce llaneous Maps,
Records of Orange County, California.
EXCEPT the West 10 feet thereof for road purposes
only.
which the owner thereof is required to install, be
waived until such time as said improvements shall
be deemed necessary and requested by the City
Engineer.
2. That the charge of $2.00 per front foot for street
lighting along Webster Street be refunded to Rever-
end James Heaps or applied to other charges yet to
be paid.
BE IT FURTHER RESOLVED that in all other respects said
Resolution No. 5169 be, and remain in full force and effect.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be placed of record in the Office of the County
Recorder of Orange County, California.
THE FOREGOING RESOLUTION is approved and signed by me
this 2nd day of June, 1959.
