59R-5265 RESOLUTION NO. 5265 /.......... A RE~SOLUTION OF THE CI'rY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A Clli~NGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF 'l'HE CITY, AND THAT ARTI- CLE IX, CHAPTER 2 OF THE ANAHEI1Il MUNI- CIPAL CODE SHOUI~ BE AMENDED TO ACCOMPLISH SAID CHANGE OF LONE. WHEREAS, the City Planning Commissioh of the City of Anaheim hs.s heretofore duly :Jassed and adopted a resolu- tion recommending denial without prejudice, of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the hold- ing of a public hearing thereon in the manner and as pres- cribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proDosed change of zone or zones, and after having received evidence and reports from persons interested therein; and VfHEREAS, within a -oeriod of forty (40) days follow- ing the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and de- clare its opinions and recsons for recommending denial of said proposed che.nge in the boundaries of the z'one or zones herein- after mentioned and described; and WHEREAS, upon receipt of the report and recommen- dation of the City Planning Commission, the City Council did thereupon fix the 2d day of June, 19.59, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a Dublic hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said pub- lic hearing, the Ci ty Council did duly hold and conduct such public hec.ring and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, ano. did thereupon consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as herein- after set forth, is more suitable for the zone or zones to which it is proposed to ch.r,nge said property and area ahd that the inclusion of said property and area in such new zone or zones will increase the value of said property and area and will not de,;reciate the values of property in adjoining zones. NOW, THEREFORE, BE IT RESOL\~D by the City Council of the City of Anaheim that all of the property and area sit- uated in the City of Anaheim, County of Orange, State of Cali- fornia, described as follows, to wit: -1- F - .58- .59-90 ~~ The Southerly 330.00 feet of the Northerly 396.00 feet of that por- tion of the Northwest quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, in the City of Anaheim, County of Orange, Sta.te of California, as per map recorded in Book 51, Page 11 of Miscellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at a point on the North line of said Section 13, North 890 41' 1511 East 1162.10 feet from the Northwest corner the:t:eof, thence South 00 10' .5511 East 1338.22 feet to a point on the South line of the North half of the Norhhwest quarter of said Section 13, distant there- on North 890 37' 3011 East 1162.58 feet from the intersection of seid South line with the West line of said Section 13; thence South 890 37' 3011 West 184.58 feet along said South line; thence North 00 10' 15" West 1338.43 feet parallel with the West line of said Section 13, to the North line thereof; thence North 890 41' 15" East 184.30 feet to the point of be- ginning. Except the Easterly 92.00 feet thereof. be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE, to C-3, HEAVY-COMI'-1ERCIAL ZONE, upon the following conditions: 1. 2. That all engineering requirements of the City of Anaheim, along Lincoln Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage faci- lities or other pertinent work, be com- plied with as required by the City Engi- neer, and in accordance with standard plans and specifications on file in the office of said City Engineer. That the owners of subject propert~ pay to the City of Anaheim the sum of ~2.00 per front foot for street lighting pur- poses. 3. That the owners of sUb ject property ple.ce of record standard City of Anaheim 0-3 deed restrictions, approved by the City Attorney. That all of the above conditions be com- plied with within a period of 90 days from date hereof or such further time as the City Council may grant. 4. -2- ,~ BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and ~irected to prepare and sub- mit to the City Council an amendment to Atiole IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Muni- cipal Code to aocomplish the object herein found and deter- mined to be neoes8&rY and proper.
