RESOLUTION NO. 5173
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM REVOKING SPECIAL USE PERMIT NO. 2
GRANTED TO JOHN SIMONE, TO BECOME EFFECTIVE
MAY 1, 1959.
WHEREAS, heretofore, to wit, on the 6th day of January,
1959, the City Council did duly pass and adopt Resolution No.
4958 granting Special Use Permit No.2 to John Simone, 9771
Harriet Lane, Anaheim, California, to establish a helicopter
sightseeing service on the following described property situated
in the City of Anaheim, County of Orange, State of California,
to wit:
The South half of the East half of the Southeast quarter
of the Southeast quarter of Section 11, Township 4
South, Range 11 West, S.B.B. & M.
EXCEPTING THEREFROM that portion of said land included
within the following:
That portion of the East half of the Southeast quarter
of the Southeast quarter of Section 11, Township 4
South, Range 11 West, S.B.B. & M., included within a
strip of land 110 feet wide, lying 55 feet on each side
of the following described center line:
Beginning at the Southeast corner of said Section 11,
(the West line of Section 13 of said Township and Range,
bears South 00 09' 50" East, from said Southeast corner);
thence along the East line of said Section 11, (said
East line being also the center line of Stanton Avenue,
60 feet wide, as declared by Action of the Board of
Supervisors of said County), North 00 111 10" West, a
distance of 612,23 feet; thence Northerly along a curve
concave Westerly, tangent to the last described course
and having a radius of 2527.00 feet, through an angle
of 190 58' 50", an arc distance of 881.23 feet.
AND WHEREAS, said Special USe Permit was granted upon
the following conditions:
1. That the landing circle area shall be not less than
250 feet from either Stanton or Lincoln Avenue.
2. That adequate dust control shall be maintained in
the landing area.
3. That the helicopters used in the operation of said
sightseeing service shall not exceed 210 horsepower.
4. That no helicopters shall be stored on the property
when not in use.

5. That there shall be no night flights in the oper-
ation of said sightseeing service.
6. That adequate off-street parking shall be provided
for customers.
7. That a 30-inch wire mesh fence shall be constructed
around the landing area.

8. That said Special Use Permit No.2 is granted for
a period of two years from date hereof, but shall
be subject to review at the expiration of one year
or upon the receipt by the City of a substantial
number of complaints from residents in the area.
AND WHEREAS, on or about the 24th day of February, 1959
the City Council did receive from the City Clerk of the City of
Buena Park a copy of a petition of protest which had been sub-
mitted to the Buena Park City Council with reference to the above-
mentioned helicopter sightseeing service, together with an excerpt
from the minutes of the Buena Park City Council meeting regarding
said petition, and the City Council did order that said matter
be held over to March 10, 1959 for consideration; and
WHEREAS, on the 10th day of March, 1959, the City
Council did receive further protests in connection with the oper-
ation of said helicopter service, and did thereupon direct that
a public hearing be set for April 7, 1959, at 7:00 o'clock P.M.,
in the Council Chamber in the City Hall, City of Anaheim, to
review Special Use Permit No.2 granted to the said John Simone
by Resolution No. 4958, and that John Simone be directed to
ap~ear before the City Council on April 7, 1959 to show cause why
said Special Use Permit should not be revoked; and
WHEREAS, the City Council does find that a Notice of
Public Hearing to Review Special Use Permit and Order to Show
Cause was forwarded to John Simone on March 13, 1959, notifying
him of the time and place when and where the City Council would
hold a public hearing to review the granting of said special
Use Permit No. 2 and to hear and determine complaints that had
been made against the operation of said helicopter sightseeing
service, and notifying him to appear at said time and place and
show cause, if any he had, why said Special Use Permit should
not be revoked, and to show cause, if any he had, why the use of
said property described in said Special Use Permit should not be
abated and discontinued; and
WHEREAS, the City Council does further find that at
the time and place specified in said notice, the said John Simone
appeared in person, and the City Council did duly hold and conduct
such hearing and did give all persons interested therein an oppor-
tunity to be heard and did receive evidence and reports, and did
defer action on the matter of said Special Use Permit for a period
of two weeks to permit further investigation by the City Council;
and

WHEREAS, the City Council does find that said Special
Use Permit should be revoked as of May 1, 1959;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Special Use Permit No.2, granted to
John Simone, 9771 Harriet Lane, Anaheim, California, by Resolution
No. 4958, to establish a helicopter sightseeing service on the
property hereinabove described, be and the same is hereby revoked,
effective as of May 1, 1959.
THE FOREGOING RESOLUTION is approved and signed by me
this 21st day of April, 1959.
