RESOLUT ION NO. 5166

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUT ION OF AN AMENDMENT OF AGREEMENT FOR
STATE ADMINISTRATION OF LOCAL SALES AND USE
TAXES.
WHEREAS, the City of Anaheim has heretofore entered
into an agreement with the State Board of Equalization for
State administration of loca~ sales and use taxes as con-
templated under Part 1.5 'offHvision 2, of the Revenue and
Taxation Code, and is now desirous of amending that agreement
in the following particulars, to wit:
That Paragraph C of Article II of said agreement
be amended to read as follows:
"C. Transmittal of money. Except as otherwise
provided herein, all local taxes collected under
the provisions of the City ordinance shall be
transmitted to the City periodically as promptly
as feasible. A statement shall be furnished
ind ica ting the amount withheld pursuant to
Article IV of this Agreement."
AND WHEREAS, the purpose of said amendment is to
conform said agreement to a plan for accelerated transmittal
of local sales tax collections as described in a letter of
March 12, 1959, addressed to Mr. Richard Carpenter, Executive
Director and General Counsel, League of California Cities,
by Dixwell L. Pierce, Secretary, State Board of Equalization,
which letter, for the purpose of said amendment, shall be
incorporated in said agreement by reference as though fully
set forth therein; and
WHEREAS, a form of amendment of Paragraph C of
Article II of said Agreement for State Administration of
Local Sales and Use Taxes, together with a copy of the
letter of March 12, 1959, addressed to Mr. Richard Carpenter
by Dixwell L. Pierce, hereinabove referred to, has this day
been submitted to the City Council by the State Board of
Equalization for approval by the Council; and
WHEREAS, the City Council finds that said form of
amendment of agreement will accomplish the changes in said
agreement herein found and determined to be necessary and
proper, and should be approved and its execution authorized
by the proper City officials.

NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the AmendDUlnt.of Agreement for
State Administration of Local Sales and Use Taxes this day
submitted to the City Council, a copy of which is on file in
the Office of the City Clerk, be and the same is hereby ap-
proved; and that the Mayor and City Clerk be, and they are
hereby authorized and directed to execute said amendment of
agreement with the State Board of Equalization for and on
behalf of the City of Anaheim.
AND BE IT FURTHER RESOLVED that the City Clerk be,
and she is hereby authorized and directed to forward five
executed copies of said amendment to the Secretary of the

State Board of Equalization, Sacramento 8, California, to-
gether with five certified copies of this resolution
authorizing the execution of said amendment.
THE FOREGOING RESOLUTION is approved and signed
by me this 14th day of April, 1959.
