A RESOLUTIOH OF THE CITY COUHCIL OF THE CITY OF
ANAHEIK FINALLY ACCEPTING THE COKPLETIOH AND THE
FURBISHING OF ALL PLAIT. LABOR, SERVICES, KA-
TERIALS AND EQUIPKENT AID ALL UTILITIES AND TRANS-
PORTATION INCLUDING POWER, FUEL AND WATER, A.HD
PERFORMING ALL WORK NECESSARY TO CONSTRUCT A.ND

WHEREAS, the City Council of the City of Anaheim did
cause to be published in a newspaper of general ciroulation,
printed, published and ciroulated in the City of Anaheim, to wit:

fied that sealed proposalS as specified in said notice would be
reoeived up until 2:00 01 clock P.M. of the 15th d81 ot
Janu.ry . 19...a.-, and which said notioe did state and
deolare that. pursuant to the provisions ot Section 1770 ot the
Labol' Code. the City Counoil of the City of Anaheim had asoel'tained
the pl'evailing rate of wages fol' each type of labor needed to exe-
cute said oontl'act and did set forth the pl'evailing hourly wage

WHEREAS. on Januarr 15 . 19.22..-, at the hour of

Oity of Anaheim did open said sealed proposals received up to that
time for the furnishing of all plant, labor~ servioes. materials
and equip.ent~ and all utilities and transportation. including
power, fuel and water, and performing all work neoessary to con-
struot and oomplete, in a good and workmanlike manner, in striot
accordanoe with the specifications, plans and drawings therefor
on file in the Offioe of the City Clerk of the City of Anaheim,
the public improvement hereinabove more particularly desoribed and
set forth, in publio. in the City Council Chamber in the City Hall,
Anaheim, California, and the City Engineer did tabulate the result
of said sealed proposals and did make a report to the City Council
at its next adj~ed regular meeting; and
WHEREAS, the City Council of the City of Anaheim did, at
its next adjourned regular meeting, held on the 20th day
of Ja.mt.a:ry , 19....22-. at the hour of 7:00 01 clock P.K.,
consider the sealed proposals submitted for furnishing the materi-
als and performing the work hereinabove more partioularly desoribed
and set forth. and did thereupon find and determine that the sealed

for the oonstruction. installation and completion of said Impravement

hereinabove mentioned and desoribed, was the lowest responsible
proposal submitted therefor. and thereupon aooepted said bid and
did award a contraot to said R. J. Boble Company
for furnishing all plaht~ labor. services. materials and equipment
and all utilities and transportation, inoluding power, fuel and
water~ and performing all work necessary to construot and complete~
in a good and workmanlike manner, in strict accordance with the
specifications. plans. and drawings~ the said pUblic improvement as
speoified in said notice inviting sealed proposals~ and did author-
ize the Mayor and the City Clerk of the City of Anaheim to exeoute
a oontraot for and on behalf of the City of Anaheim with R. J.

which said oontract was duly made and entered into on the 22Dd
day of January ~ 1922--; and

and transportation, and performed all work necessary for the oon-
struction and oompletion~ in a good and workmanlike manner, in
striot aooordanoe with the speoifications. plans, drawings, of said
publio improvement as speoified in the notice inviting sealed pro-
posals and in the detail, design. plans. prOfiles. drawings and
speoifioations prepared by Thornton E. Piersall, City Engineer

into with it by the City of Anaheim; and

oertified to the oonstruction and completion of said public improve-
ment hereinabove mentioned and desoribed, in aocordanoe with the
plans and specifications and the contract doouments duly made and

WHEREAS~ the City Counoil finds that said oontractor has
completed said pUblic improvement hereinabove more particularly de-
soribed in aocordance with the prOVisions of the contract and the
oontract documents, and that notice of completion should be filed
and payment of the balance due said oontractor authorized in accord-
ance with the contraot documents.

NOW 9 THEREFORED BE IT RESOLVED by the City Council of the
City of Anaheim that all plant>> labor. servicess materials and
equipment and all utilities and transportations and the performanoe
of all work neoessary to construct. install and oomplete, in a good
and workmanlike manner. in strict accordance with the speoifica-
tions>> plans and drawings therefor on file in the Office of the Oity
Olerk of the City of Anaheim. together with the appurtenanoes
thereto. said public improvement hereinabove more partioularly de-
soribed and set forth>> in the City of Anaheim. by said contractors
be. and the same are hereby aocepted. subject. nevertheless, to all
the termS9 conditions and provisions of the oontraot doouments. and
that the balance due said oontractor for said work be paid to it
thirty-five (35) days from and after final acoeptanoe of said work
as evidenoed by the adoption of this resolutions but not sooner than
thirty (30) days after the date of the filing of notioe of oom-
pletion. exoepting only such sum or sums as may lawfully be withheld
in acoordanoe with the provisions of said oontraot and oontract
documents. That acceptance by the contractor of said payments made
in acoordance with said final estimate shall operate and shall be a
release to the City of Anaheim. its officerss agents and employees
from all claims and liabilities due the contractor for anything
done or furnished or withheld or for anything relating to the work
or any act or neglect of the City>> its officers. agents and em-
ployees, excepting only olaims against the City for any amounts
withheld by the City at the time of suoh payment.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be. and they are hereby authorized to
exeoute and file a notioe of completion of said work as required
by law.
