59R-5136 ~ RESOLUTlCJN NO. 5136 A HESOLUTICJN OF THE CITY COUNCIL OF THE CITY Of ANAHEm ORDERING THE VACATION AJlJD ABANDON- MENT OF A PORTION OF WINSTON ROAD AND AN EASEffiENT FOR RO}\D PURPOSES UPON, OVER, ACROSS AND ALONG THE HEREINAFTER DESCRIBED REAL PROPERTY. \.yHEHEJ\.S, the City Council of the City of Anaheim, a muniCipal corporation of the State of California, did on the nUL day of fvlarcl:., 1959, pass its Ordinance No. l33~-, entitled "AN ORDINANCE OF THE CITY OF ANAHEIM DECLARING THE INTENTION OF THE CITY COUNCIL Te VACATE AND ABANDON A PORTION OF WINSTON ROAD AND AN EASDfJENT FOR ROAD PURPOSES UPON, OVER, ACROSS AND ALONG THE HEREINAFTER DESCRIBED REAL PROPERTY; FIX- ING A TH~E AND PLACE FOR A HEARING THEREON; AND DIRECTING THE POSTING OF NOTICES THEREOF AND THE PUBLICATION OF THIS ORDINANCE, II whereby it declared its intention to vacate and abandon and close to public use a portion of Winston Road and an easement for road purposes upon, over, across and along the hereinafter described property under the provisions of the Stl'eet Vacation Act of 19L!I; and \.vHEREAS, the City Council in said Ordinance referred to a map on file in the Office of the City Clerk for further particu12,rs as to the proposed vacation, abandonment and closing to public use of said portion of Winston Road and easement for road purposes; and \vI-IEHEAS, said City Council did by said Ordinance fix the 7th day of Apr iI, 1959, at 7: 00 0' c 1 oek P .[VI., in the Counc i I Chamber in the City Hall of the City of Anahe im as the time and place for a public hearing on the matter of such vacation, abandonment and closing to public use of said portion of road and easement for road purpOSES, for all persons interested in or objecting to such proposed vacation, abandonment and closing to pub I ic use to appear and 5])011{ cause, if any they had, why such portion of road and easement for road purposes should not be vacated, abandoned and closed to public use; and VlH[};:?AS, said Ordirlance ",as published on the 19th day of March, 1959, in the Anar-,eim Gazette, a newspaper of general circulation, printed, published and circulated in the City of Anaheim, Orange County, California; and \~1EREAS, by said Ordinance said City Council directed that notices of the passage of said Ordinance and of the time and place of the hearing on the matter of the vacation, abandon- ment and closing to public use of said portion of road and ease- ment for read purposes be pcsted conspicuously along the line of said portion of road and easement proposed to be vacated, not more than 300 feet apart, at least ten (10) days before said hearing, and that not less than three (3) such notices should be posted; and .--- ~lll1E;:;'EAS, r:yron C. I.. 0 C OCL " -.., ~ sa I y , con uc a pU IC hearing on thE: matter of whether said portion of i'i'inston Road and easement fcr road purposes, hereinafter described, should be vacated, abandoned and closed to public use, and at said hearing did hear evidence thereon; and ~VHEHEAS, the City Counc il finds from all the evidence submitted that that portion of irJinston Road and easement for road purposes described in the Ordinance of Intention and hereinafter described, are unnecessary for present or prospective road purposes, and that an order vacating such portion of road and easement for road purposes as described in the Ordinance of Intention should be made by the City Council. NOW, T}~REFORE, BE IT RESOLVED by the City Council of the City of Anaheim: 1. That it finds the recitals hereinabove set forth in this Resolution to be true; 2. That it finds from all the evidence submitted that said portion of Winston Road and easement for road purposes described in said Ordinance are unnecessary for present or pro- spective public purposes; 3. That it does hereby order that said portion of irJinston Road and said easement for road purposes be, and they are hereby, vacated, abandoned and closed to public use; 4. That the said portion of road and easement for road purposes herein ordered vacated, abandoned and closed to public use are those described in said Ordinance No. 1334, are situated in the City of Anaheim, County of Orange, State of California, and are more particularly described as follows: That portion of Winston Road and easement for road purposes upon, over, across and along the following described property: .- Beginning at the intersection of the center lines of West Street and Winston Road; thence Easterly along the center line of said Winston Road 1497.32 feet; thence Southerly 20 feet, as measured at right angles from the last mentioned center line to the true point of beginning; thence, Easterly and Northerly along a curve concave Northerly and having a radius of 503.74 feet through a central angle of 50 421 18" a distance of 50.16 feet to a point, said point being the begin- ning of a reverse curve also having a radius of 503.74 feet and a central angle of 50 lL21 IS!!; thence, along said reverse curve a distance of 50.16 feet to a point, said point being in a line parallel with and 15 feet South of the center line of said Winston Road; thence, Easterly parallel with and 15 feet South of the last mentioned center line 23~_.17 feet to the beginning of a curve concave Southerly and having a radius of 503.71, feet; thence, Easterly along the last mentioned curve through a central angle of 50 42' 18" a distance of 50.16 feet to the beginning of a reverse curve also having a radius of 503.74 feet and a centre 1 -2- ,,--. angle of 50 !J2' 1811; thence along said reverse curve a distance of 50.16 feet to a point, said point being in a line parallel with and 20 feet South of said center line of Winston Road; thence, Westerly parallel with and 20 feet South as measured at right angles of the last mentioned center line 484.47 feet to the true point of beginning. AND BE IT FURTHER HESOLVED that the City Clerk be, and she is hereby, author ized and directed to cause a certified copy of this Resolution and Order, attested by her under the seal of the City of .~aheim, to be recorded in the Office of the County Recorder of Orange County, California.
