4075ORDINANCE NO. 4075 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the Planning Commission did adopt its Resolution No. PC79-143 determining that a change or changes in the zone or zones hereina ter mentioned and described should be made as hereinafter set forth after a duly noticed hearing; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: The Southerly 340.00 feet of that portion of the South half of the Southeast quarter of the South- west quarter of Section 119 Township 4 South, Range 11 West, San Bernardino Base and Meridian described as follows: Beginning at a point on the South line of said Section 119 188 feet East of the Southwest corner of said South half of the Southeast quarter of the Southwest quarter of said Section 11; running thence East along said South line, 167.42 feet; thence North parallel to the West line of said South half, 520.33 feet to a point in the South line of that certain parcel of land conveyed by the First National Bank of Santa Ana to Howard S. Strange and wife by deed recorded August 179 1928; thence West parallel to the North line of said South Half of the Southeast quarter of the Southwest quarter, 167.42 feet; thence South parallel to the West line of said South half, 520.45 feet to the point of beginning, now is "RS -A-43,000" RESIDENTIAL/AGRICULTURAL ZONE and that it be changed to and incorporated in "RM -3000" RESIDENTIAL, MULTIPLE - FAMILY ZONE subject to the following conditions: -1- ATTY-26 79-80-4 1. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Public Works Executive Director. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 3. That subject property shall be served by underground utilities. 4. That drainage of subject.property shall be disposed of in a manner satisfactory to the City Engineer. 5. In the event that subject property is to be divided for the purpose of sale, lease, or financing, a tract map, to record the approved division of subject property shall be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder. 6. That the owners of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 7. That the owners of subject property shall pay the traf- fic signal assessment.fee (Ordinance No. 3896) in an amount as determined by the City Council,.for each new dwelling unit prior to the issuance of a building permit. 8. That Condition Nos. 1,.3 and 4, above-mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which itis now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to- prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3: The City -Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. -2- THE FOREGOING ORDINANCE is approved and adopted by the City Council of the City of Anaheim this 30th day of October, 1979.
