59R-5076 ....... ",-.. RESOLUTION NO. 5076 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIA.-r.JCE NO. 1081. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from the property owners of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: The Westerly 200 feet of that portion of the J. W. Clark's Addition to Anaheim, as shown on a map re- corded in Book 31, Page 100 of Miscellaneous Records of Los Angeles County, California, and that portion of the Helen and Lynch's Subdivision, as shown on a map recorded in Book 4112, Page 158 of Deeds, Records of Los Angeles County, California, described as follows: Beginning at the Southwest corner of land described in a deed to Douglas Oil Co. of California, a corporation, recorded November 17, 1958 in Book 4L~83, Page 438 of Official Records, said point being on the center line of Landing Road, now known as Euclid Avenue, distant Southerly 190.00 feet from the intersection of said center line with the center line of Broadway, as shown on said map of J. W. Clark's Addition to Anaheim; thence Southerly along said center line of Euclid Avenue, a distance of 26.00 feet; thence Easterly parallel with said center line of Broadway to the Easterly line of land described in a deed to Harry Sham and wife, recorded May 9, 1958 in Book 4281, Page 269 of Official Records; thence Northerly along said Easterly line to a line that is parallel with said center line of Broadway and extends Easterly from the point of beginning; thence Westerly along said parallel line to the point of beginning. (Said property is located at 316 South Euclid Avenue, Anaheim, California.) AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on February 2, 1959, notices of which said public hear- ing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 154, recommending to the City Council of the City of Anaheim that Variance No. 1081 be granted upon the conditions stated in said resolution; and WHEREAS, the City Council does find that: .r'. 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. -1- .-.. - ~ 2. That such a variance is necessary for the preser- vation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to HARRY SHAM and LILLIAN SHAM, 1320 Ridgeview Terrace, Fullerton, California, to construct and operate a Family Restaurant and Cocktail Lounge on the property hereinabove described, upon the following conditions: 1. That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other pertinent work be complied with as required by the City Engineer, in accordance with plans and specifications on file in the office of said City Engineer. 2. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 3. That the building to be constructed on subject property shall be erected in accordance with the revised plot plan and renderings this date sub- mitted to the City Council and on file with the City of Anaheim. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, or their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 10th day of March, 1959.
