A RESOLUTION OF THE CITY COUNCIL.OF THE CITY OF ANA-
HEIR ACCEPTING A SEALED PROPOSAL AND AWARDING A CON-
TRACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE
FURNISHING OF ALL PLANT, LABOR, SERVICES, MATERIALS
AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION,
INCLUDING POWER, FUEL AND WATER, AND PERFORMING ALL
WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOW-

WHEREAS, the City Council of the City of Anaheim did cause to
be published in a newspaper of general circulation., printed, published
and circulated in the City of Anaheim, to wit: The Anaheim Gazette
on the 12th and lqt9 d~vs of FebruarYr lq,q ~
a notioe inviting sealed proposals for furnishing the following:

All plant, labor, services, materials and equipment, and
all utilities and transportation, including power, fuel
and water, and parforming all work necessary to construct,
and complete in a good and workmanlike manner, in strict
accordance with the specifications, plans and drawings
therefor on file in the office of the City Engineer or
City Clerk of the City of Anaheim, the following public
improvement, to wit: The Broadway Street Sewer Improve-
ment, consisting of the construction of an 8-inch V.C.p.
sewer lateral in Broadway, from 680 feet west of Magnolia
Avenue to Shields Drive, including the construction of
4-inch house laterals, wyes, stoppers, standard 4-foot
brick manholes, construction of temporary 1-1/2 inch pave-
ment, and appurtenant work as indicated on the plans,
Job No. 1151,
in accordance with the design, plans, prof~les and specifications o:f
said ~ublic improvement on file in the office of the City Clerk of the
Ci ty of Anaheim; and
WHEREAS, said notice inviting sealed proposals. for said public
improvement did provide that sealed proposals would be received by the.
City of Anaheim at the office of the City Clerk of the City of ~heim
up to the hour of 2! 00 0' clock P.M:. on the 26th day of F~hf'11~f'Y
19~, for the furnishing of all plant, labor, services, lIB. edale,
and equipment, all utilities and transportation, including power, fuel
and water, and performing all work necessary to construct and complete
in a good and workmanlike manner, the public improvement here1lu1bove
more particularly mentioned and described, and which notice did state
and declare that pursuant to the provisions of Section 1770 of the
Labor Code, the City Countlll of the City of Anaheim bad ascar;ta1ned
the prevai1ing rate of wages in the 1oca1ity in which this type of
labor is to be performed for each craft or type of workman or ~chanic
needed to execute the contract and did set forth the prevailing hourly
wage scale so ascertained; and

the fo11oving sealed proposals prior to 2%00 o'clock P.M:. on the

WHEREAS, the City Council finds that the above menti.oned sealed
proposal is the lowest responsible proposal receiv.ed and that the per-
sen, firm or corporation submitting said proposal is a resp.onsib:Le
person, firm or corporation and that the proposal submitted.is the
best suited and fitted for the public improvement to be constructed.
NOW, THERiroRE, BE IT RESOLVED by the C~ty Council of the. City
of Anaheim, that the sealed proposal submitted by DE LEON CONSTRUCTION
CO.. 131 Coffman Avenue. Anaheim. California
for the furnishing of all plant, labor, services~ materials and equip~
ment, all utilities and transportation, including pDWer,. fuel and water,
and performing all work necessary to construct and comple:te, in a good
and workmanlike manner, in strict accordance with the specificati'ons,
p1ans. and drawings therefor on file in the offi.ce of the. City Clerk of
the 01 ty of Anaheim and the ootic.e inviting: sealed propo.sals:, the pub-
lic works and improvement hereinabove more particularly mentioned and
described, together with the ~ppurtenances thereto, be, and the same
is hereby, accepted, and that a contract for the. construction and com-
pletion of said public improvement be, and the s.ameishereby, awarded
to the said above named bidder.

AND BE IT FURTHER RESOLVED that thesuccess:fulbidder or bidders
upon each contract awarded as hereinaQ~ve set forth, shall he, and they'
are hereby required to execut.e a contriict in the required form with the
Ci t.y of Anaheim upon the .terms and conditions specified in the notice
inviting sealed proposals and the proposal submitted by said success-
ful bidder or bidders and in accordance with the plans and specifica-
tions for said public improvement hereinabove described, and in accord-

and that said successful bidder or bidders to whom eachcontraot is
awarded shall be required to furnish a surety bond in an amount equal
to one hundred per cent (100%) of the contract price. for~all labor,
materials and equipment. to be furnished and performed~ as sat forth
in the sealed proposal submitted by said bidder for ther construction
of said public improvement, together with the appurtenances there.:t.o
or such portion thereof as is covered by said contract,: as $Ercu:cit;y.
for the faithful performance of said contract and a separa~e sUrety
bond Ul an amount equal to one hundred per cent (lOO?') of the con-
struction cost of said public improvement covered by said.oontract,
as security for the payment of all persons performing labor.and fnr-
nishing material for said project.
~ BE IT FURTHER RESOLVED that said Successful bidder or
bidders be, and they are hereby required to furnish to the City of
