59R-5041 .- .- RESOLUTION NO. 5"041 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NOo 1078 . WHEREAS, the City Planning Commission of the City of Ana- heim did receive a petition for zoning variance from Rich~rd of certain real property ounty of range, State of California, Beginning at the Northwest corner of Section 22, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California; thence due East along the center line of Ball Road, a distance of 330.31 feet, thence due South at right angles to the center line of Ball Road, a distance of 200 feet, thence due West a distance of 130.31 feet parallel to the North line of Ball Road, thence due North a distance of 200 feet parallel to the East boundary line. (Said property is located at 1050 West Ball Road, Anaheim, California.) AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on Januar~ 19 , 19 1)9 . notices of which said public hearing were du y given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code~ and WHEREAS, said City Planning Commission, after due inspec- tion, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1/18, SerIes 19 t;"8_r,Q , gr..n+ tng Variance No. 1078. upon the conditions therein set forth ; ana WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Com- mission in qrantinq said variance and did set a public hearing thereon to be held on the 17th day of Februarv. 19~9 , at 7:00 o'clock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provi- sions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, the City Council does find that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be ade- quately developed and used under the present zone. - NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting Variance No. 1078 to Richard Anthony, 1200 West Ball Road, Anaheim, California, to construct a family restaurant with cocktail lounge on the property hereinabove described, be, and the same is hereby disapproved, and that Variance No. 1078 be, and the same is hereby denied. =1- -~ THE FOREGO 100 RESOLUT ION is approved and s i gne d by me this 17th day of RphT'll"'T';lT , 195'9 .
