A RESOLUTION OF TEE CI'rY COUNCIL OF THE CITY
OF A.NAHEIM AUTHORIZING THE PURCHASE AND ACQUI-
SITION OF CERTAIN REAL ~ROPERTY FOR MUNICIPAL
PURPOSES.

WHEREAS, Geraldine N. Westrall, an unmarried woman, is
owner of the hereinarter described real property situated in
City or Anaheim, County or Orange, State of Calirorniaj and
WHEREAS, said owner has ofrered to sell said property
to the City of Anaheim ror the sum of $30,000.00 cash, lawful
money of the United Statesj and
WHEREAS, the City Council does rind and determine that
public convenience and neoessity require the purohase and aoqui-
sition or said paroel or real property for munioipal purposes,
and that the price whioh the owner thereof is willing to acoept
is reasonable and not out of proportion to the fair market value
of said property.
.NOW, THEREFORE, BE IT RESOLVED by the City Counoil of
the City of Anaheim that the offer of Geraldine N. Westfall, an
unmarried woman, to sell said property, situated in the City of
Anaheim, County of Orange, State of California, desoribed as
follows, to wit:
Lot 6 in Block K of the New Subdivision
or Vineyard Lot D Five, in the City or
Anaheim, as shown on a map thereof
recorded in Book 17, Page 72, Miscel-
laneous Records or Los Angeles County,
California,
ror the sum of $30,000.00 cash, lawful money of the United States,
be and the same is hereby accepted, subject to the following
terms and oonditions:
1. That subject property shall be conveyed to
the City of Anaheim free and clear of all encumb-
rances except the second half of general and special
taxes ror the fiscal year 1958-59, including any
speoial district levies, payments for whioh are
included therein and collected therewith, and cov-
enants, conditions, restrictions, reservations, rights,
rights-or-way and easements of record.
2. That the taxes and insurance shall be pro rated
as or the close of escrow.
BE IT FURTHER RESOLVED that the City Manager or the
City or Anaheim be, and he is hereby, authorized for and on
behalf of the City of Anaheim to sign escrow instructions for
the purchase or said real property and to enter into an escrow
with the owner of said property at Bank of America,National
Trust and Savings Association, Anaheim Branch, 150 East Center
Street, Anaheim, Calirornia.

AND BE IT FURTHER RESOLVED that the City Auditor be,
and he is hereby, authorized to deposit in escrow at Bank of
America, National Trust and Savings Association, Anaheim Branch,

150 E. Center Street, Anaheim, California, the sum of $30,000.00
cash, lawful money of the United States, to be paid to the owner
of said real property when a deed conveying said property to the
City of Anaheim free and clear of all encumbrances, except as
hereinabove set forth, can be recorded and a policy of title in-
surance issued by Security Title Insurance Company showing said
property vested in the City of Anaheim free and clear of all
encumbrances, except as hereinabove specified.
AND BE IT FURTHER RESOLVED that the seller shall pay
the usual and customary seller's charges for furnishing a policy
of title insurance necessary to show title vested in the City of
Anaheim, as herein provided, and that the City of Anaheim shall
pay the usual buyer's share in the purchase of said property.
THE FOREGOI.NG HESOLUTION is approved and signed by me
this lOth day of February, 1959.
