A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM RESCINDING RESOLUTION NO. 4994
GRANTING VARIANCE NO. 1067 TO J. H. MULVEY.
WHEREAS, heretofore, to wit, on the 20th day of
January, 1959, the City Council adopted Resolution No. 4994
granting Variance No. 1067 to J. H. Mulvey; and
WHEREAS, it appears upon further investigation that
when the application for said variance was filed by the appli-
cant, it requested a variaace for the construction of a build-
ing to be devoted to C-1, NEIGHBORHOOD-COMMERCIAL uses without
specifying any particular use; and
WHEREAS, it further appears that the resolution
adopted by the Planning Commission granted said variance for
C-l uses; and
WHEREAS, upon the advice of the City Attorney, the
Council finds that said resolutions are contrary to the pro-
visions of the Anaheim Municipal Code relating to zoning, and
that said application should be referred back to the City Plan-
ning "Commhston1'1:lramendment and further proceed ings, or for
the filing of a new application;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Resolution No. 4994, granting
Variance No. 1067 be, and the same is hereby rescinded.
BE IT FURTHER RESOLVED that the application for said
Variance No. 1067 be referred back to the City Planning Commission
for amendment and further proceedings, or for the filing of a
new application by the applicant for a variance for a specific
use.
BE IT FURTHER RESOLVED that no additional filing fee shall
be required from the applicant.
THE FOREGOING RESOLUTION is approved and signed by
me this 3rd day of February, 1959.
