A RESOLUTION Of THE CITY COUNCIL OF THE CITY OF ANAHEIM
DENYING VARIANCE NO. 1066

WHEREAS, the City Planning Commission of the City of Anaheim
did receive a petition for zoning variance from M.L. R~r~An,
the owner'
of certain real property
situated in the City of Anaheim, County of Orange, State of California,
described as follows::
Lot No. 29 in Tract No. 3256.
(Said property ~cs loca~ed at 1404 Hacienda Stneet, Anaheim.)
AND WHEREAS. the City Planning Commission
heariqg at the City Hall in the City of Anaheim on

quired by law and the provisions of Section 9200.17

WHEREAS, said City Planning Commissiong after due inspection,
investigation and studies made by itself and in its behalf. and after
due consideration of all evidence and reports offered at said hearing,
did adopt Resolution No. 126 Series 19~-59 , denvin~
Variance No. 1066 I and
WHEREAS, thereafter, within twenty (20) days from the date of
the adoption of said resolution. a written appeal was fUed with the
City Council of the City of Anaheim protesting the action of the City
Planning Commission denying said variance, and said appeal was
set for public hearing on January 20 , 19 ~q , at 7~OO
o'clock P.M. at the City Hall in the City of Anaheim, and notice of
such public hearing was duly given as required by law and the provi=
sions of Section 9200.17 of the Anaheim Municipal Code~ and
WHEREAS, after due investigation and studies made by itself
and in its behalf, and after due consideration of all the evidence and
reports offered at said hearing, the City Council does find and de-
termine tha t:
1. There is no substantial property right possessed by
other property in the same vicinity and zone and denied
the subject property.
2$ It appears that the subject property can be adequately
developed and used under the present zone.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the action of the City Planning Commission
__ denying the petition of H.L. Bergman f'or a waiver of' the se'tback
requirements on the proper.ty hereinabove described, to allow the
erection of' a fence with gate, and a carport, be, and the same is
hereby sustained, and that Variance No. 1066 be, and the same is
hereby denied.
