RESOLUTION NO. 4911

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXEaJT ION OF AN AGREEMENT TO BE MADE
AND ENTERED INTO WITH THE ATCHISON, TOPEKA
AND SANTA FE RAILWAY COMPANY FOR A LICENSE
TO USE CERTAIN PREMISES OF SAID RAILWAY
COMPANY FOR THE CONSTRUCTION AND OPERATION
OF A DRAINAGE DITCH.
WHEREAS, the Atchison, Topeka and Santa Fe Railway
Company, a Kansas Corporation, has tendered to the City of
Anaheim a license agreement dated November 18, 1958, granting
to the City of Anaheim, subject to the terms, covenants and
conditions therein contained, a license to use the land owned
by said Railway Company situated at or near Anaheim, California,
outlined in red coloring on the print, No. L-5-23253, dated
November 13, 1958, marked "Exhibit A", attached to and made a
part of said license agreement, dated November 18, 1958, for
the construction. operation and maintenance of a drainage ditch;
and
WHEREAS. said license agreement has this day been
submitted to the City Council for consideration and the City
Council does find and determine that it would be for the bene-
fit and best interest of the City of Anaheim to enter into
said license agreement with the said railway company;
NOW, THEREFORE. BE IT RESOLVED by the City Council
of the City of Anaheim that the License A~eement dated
November 18. 1958, tendered to the City of Anaheim by the
Atchison, Topeka and Santa Fe Railway Company, a Kansas
Corporation, granting to the City of Anaheim, but subject to
the terms, covenants and conditions therein contained, a
license to use the land or premises owned by said railway
company, situated at or near Anaheim, California, outlined in
red coloring on the print No. L-5-23253, dated November 13,
1958. marked "Exhibit A", attached to and made a part of said
license agreement, for the construction, operation and mainten-
ance of a drainage ditch, be, and the same is hereby approved
and accepted.
AND BE IT FURTHER RESOLVED that the Mayor and City
Clerk be, and they are hereby authorized to execute said agree-
ment above mentioned for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 9th day of December, 1958.
