58R-4395 ~ RESOLUTION NO. 4395 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DETERMINING THE :NECESSITY FOR, AND DIRECTING THE ACQUISITION EYEMINENT DOMAIN OF, REAL PROPERTY FOR A FIRE STATION. Copy to Attorney and Director of Finance WHEREAS, public convenience and necessity require the construction, completion and operation or a public improvement within the City of Anaheim, to wit: A fire station; and WHEREAS, the City Council does rind and determine that public interest and necessity require the acquisition of all that certain real property herein described by the City of Anaheim for the construction and operation of a rire station; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that public interest and necessity require the acquisition of that cartaim real property situated in the City of Anaheim, County of Orange, State of California, more particularly described as follows, to wit: A parcel of land located in the City of Anaheim, County of Orange, State of California, being North 132 feet of the South 152 feet of the East 100 feet of the West 411.68 feet of the Southwest Quarter (swi> of the North- east Quarter (NEt) or Section 13, Township 4 South, Range 11 West, S.B.B. & M., more particularly described as follows: Beginning at a point in the West line of Tract No. 2864 as said West line is shown on a map filed in Book 88, Page 21 of Miscellaneous Maps in the office of the County Recorder of said Orange County, said point being 152 reet Northerly of the monumented center line of Orange Avenue; thence, Westerly along a line parallel with said center line 100 feet; thence, Southerly along a line parallel with the West line of said Tract No. 2864, 132 feet to a point, said point being 20 feet North of said center line; thence, Easterly parallel with and 20 feet North of said center line 100 feet to the point of intersection with the Southerly prolongation of the West line of said Tract No. 2864; thence, Northerly along said Southerly prolon- gation and West line 132 feet to the point of beginning. BE IT FURTHER RESOLVED that the City Council does hereby find and determine that public interest and necessity require the acquisition of said land by the City of Anaheim for the con- struction, completion and operation of the aforesaid project, and that the taking of the property hereinabove described is necessary therefor, and that the use to which it is to be applied is a use authorized by law, and the taking of said property is necessary to such use. -- NOW', THEREFORE, IT IS HEREBY AUTHORIZED that said property be acquired by the City of Anaheim, and the City Attorney of the City of Anaheim is hereby directed to institute an action in -1- ,,-- eminent domain for the acquisition of the title to said property, and to perform and carry out all of the necessary proceedings and steps incident to the acquisition of the title to said property and to obtaining possession thereof. AND BE IT FURTHER RESOLVED that RESOLUTIOI NO. 4307 be, and the same is hereby rescinded.
