1967-090 RESOLUTION NO. 67R-90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 912 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from DAVID MADDOX, 111 N. Western Avenue, Anaheim, California, to establish an animal hospital on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The North 135.00 feet of the South 175.00 feet, measured at right angles, of that portion of the southeast quarter of the southwest quarter of section 11, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as shown on a map recorded in Book 51, page 11 of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: Beginning at the southeast corner of said southeast quarter of the southwest quarter; thence South 890 42' 10" West 297.69 feet along the south line of said southwest quarter to the southwest corner of the land conveyed to J. K. Doyle and wife, by deed recorded April 21, 1953, in book 2490 page 157 of Official Records; thence North 30 05' 35" West 216.59 feet along the west line of said land conveyed to Doyle to an angle point therein; thence North 00 29' 31" West 144.02 feet along said west line to an angle point therein; thence North 890 41' 55" East 309.06 feet to a point in the east line of said southeast quarter of the southwest quarter, North 00 14' 50" West 360.28 feet from the point of beginning; thence South 00 14' 50" East 360.28 feet to said point of beginning. EXCEPT the East 163.00 feet thereof, measured at right angles from the easterly line thereof. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City o~ Anaheim upon said application on January 16 , 1967 ,notices of \ which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the .naheim- MUnicipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC 67-12 Se~ie& ., granting C,onditiQ1ial Use Permit No. 912, subiect to the conditions therein set forth and -1- WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to~~ew the action of the City Planning Commission in qrantinq said Conditional Use Permit ~nd did thereupon fix the 14th day of February _, 19~7 ,as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Condition~l Use Permit, and notices of such public hearing were duly given as required by law and the provisions 'of Title 18, Chapter 18.16 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public he~ring, the City Council did duly hold and conduct'suchhear- ing ~nd did give all persons inrerested therein an opportunity' to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful conside- ration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing,th.at~ 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. The size and shape of the site proposed for the use is adequate to allow. the full.qevelopment of the proposed use in. a manner not detr~menta1 to the particular area nor to the peace, health, safety and genera.lwelfare. The traffic generated by th~ prop~se~ use wil~ not impose an undue burden upon t~s~eets and h1.gh~ ways design.ed and improved to carry .the traffic in the area. 2. 30 4. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW~ THE:REFORE~ BE IT RESOLVED by the City Council of t~e 9ity of Anaheim that the action of the City Planning Com- m1.SS1.on qrantinq said Conditional Use Permit be, and the same is hereby sustained , and that Conditional Use Permit No. 912 be, and the same is hereby, granted permitting the establishment of an animal hospital on the property herein- before described, subject to the following conditions: 1. That trash storage areas shall be provided in accord- ance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 2. That this conditional use permit is granted subject to the completion of Reclassification Proceedings No. 66-67-47 now pending. 3. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2 and 3. -2= The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner ,his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the condition(s) herein.
