58R-4364 .-, -" RESOLUTION NO. 4364 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AGREEMENT FOR THE MAINTENANCE OF CERTAIN PROPERTY BELONGING TO THE ANAHEIM ELEMENTARY SCHOOL DISTRICT, AND USED IN THE JOINT COMMUNITY RECREATION PRO- GRAM OF THE CITY OF ANAHEIM, THE ANAHEIM UNION HIGH SCHOOL DISTRICT. AND THE ANAHEIM ELEMENTARY SCHOOL DISTRICT; AND AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE SAID AGREEMENT. WHEREAS, the City or Anaheim and The Anaheim Elementary School District, together with the Anaheim Union High SchoGl District, have previously emtered into an agree- ment ror a joint program of community recreation; and WHEREAS, the City Council does hereby determine that in aid or said program, it is necessary and convenient to enter into an agreement whereby certain property owned by The Anaheim Elementary School District should be maintained by the City or Anaheim under the provision that the cost or such maintenance should be borne by The Anaheim Elementary School District; NOW, THEREFORE, BE IT RESOLVED by the City Council or the City or Anaheim that the City or Anaheim enter into an agreement ror the maintenance or certain property, owned by The Anaheim Elementary School District, by the City or Analleim on the rollowing terms: 1. The City or Anaheim shall use its equipment and rurnish all necessary labor, water, electricity, and other supplies ror the maintenance or those parcels of land owned by The Anaheim Elementary School District which are adjacent to park property owned by the City or Anaheim, and which are open grounds not covered by buildings or other structures or racilities, and which are used in the community recreation program, it being understood that the agreement shall be ror ground maintenance only. 2. The Anaheim Elementary School District ahall pay to the City or Anaheim, on demand, all actual expense incurred by the City or Anaheim ror such maintenance, including expense ror labor, compensation insurance, retirement, and the actual cost to the City or Anaheim ror all commodities and materials used or expended ror such maintenance, plus an overhead and administrative cost or rirteen (15) per cent or said actual cost. ,""""""" 3. The City or Anaheim shall submit itemized demands to The Anaheim Elementary School District once each month during the term or said agreement ror maintenance expense, ror the prior month. -1- ,- ,,.-.. 4. The term of said agreement shall be from January 1, 1958 through June 30, 1956, and may be extended from month to month after the expiration of said term by mutual agreeaent, by motion of the governing bodies of both parties to said agreement.
