58R-4311 ..- RESOLUT ION NO. 4311 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAP1'ER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the 'City Planning Commission of the City of Ana- hela has heretofore duly passed and adopted a resolution declaring Its intention to change th. boundaries of the zone or zones herein'" arter mentioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change ot lone or zones, and did receive evidence and reports from persons Interested therein; and WHEREAS, within a period of forty (40) days following the tinal hearing thereon, the Planning Commission did duly announce by formal resolution its findings of racts and declare Its opinions and reasons for recommending an amendment to said Article IX, Chapter 2 ot the Anaheim Municipal Code to effect the proposed chang.. in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the ~day of Jan~f ' 19S8 , as the time and the Council ~In the City Wat of the City of Anaheim as the place for a p.)llc hearing upon said proposed change of zone, and did give notice thereof In the manner and as provided In said Article IX, Chapter 2 ot the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be h.ard and did receive evidence and reports, and did thereupon con- sld.r the recommendations ot the City Planning Commission; Ind WHEREAS, the City Council does find Ind determine thlt the prop.rty and arel proposed to be changed trom the lone In which it ts now tltuated to a dtfferent zone, al heretnaft.r set forth, Is more suitable for the lone or zones to which It Is proposed to change said property and area and that the Inclusion of said prop.rty Ind are. in such n.w zone or lone. will Increas. the value of said property and area and will not depr.clate th. vllue. of prop.rty In adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described a. followw, to wit: The West 85 feet of the East 395 feet of the Southwest quarter of the Southwest quarter of the Southwest quarter of Section 14, Township 4 South, Range 11 West, S.B.B. & M. j<':;XCEPTINGTF.EREFRm4 the North 264 feet. -1- r- r" ".; ~ ~/ -' .' "~. be changed from R-A. RESIDENTIAL-AGRICULTURAL ZONE to R-,. MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owner of subject property deed to the City of Anaheim a strip of land 53 feet in width from the center line of Ball Road, for street widening purposes. 2. That a 50-foot building setback be established from the north line of the property. 3. That the owner of subject property place of record stand- ard City of Anaheim R-) Deed Restrictions, approved by the City Attorney. 4. That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other pertinent work be complied with as required by the City Engineer. 5. Said change of zone shall not become effective unless within sixty days, or such further time as the Council may grant, the restrictions herein required to be imposed upon the property shall have been executed by the owners of the property, submitted to the City for approval and filed of record, nor until deeds for street widening or utility purposes, when required, have been executed and delivered to the City. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
