A RESOLUTION Of THE CITY COUNCIL Of THE CITY Of ANAHEIM AUTHORIZING THE MAYOR AND THE CITY CLERK TO ENTER INTO AN AGREEMENT WITH THE ORANGE COUNTY flOOD CONTROL DISTRICT fOR THE CONSTRUC- TION Of REINfORCED CONCRETE CULVERTS AT STREET CROSSINGS AT EUCLID, KAT ELLA AND CERRITOS AVENUES; AND AUTHORIZING PAYMENT Of THE CITY'S PERCENTAGE Of THE COST Of SAID CULVERTS. WHEREAS, the Orange County Flood Control District, a body corporate and politic, proposes to construct reinforced concrete culverts at street crossings at Euclid, Katella and Cerritos Avenues; and V1HEREAS, the obligation of the Orange County Flood Control District when constructing reinforced concrete culverts at street crossings, would be to construct a 40-foot culvert at Euclid Avenue, a 77-foot culvert at Katella Avenue and a 40-foot culvert at Cerritos Avenue; and WHEREAS, the City desires that said culverts above mentioned be constructed to ultimate 1en~th, which would be a 96-foot culvert at Euclid Avenue, a lQ4-foot culvert at Katel1a Avenue and a 74-foot culvert at Cerritos Avenue; and WHEREAS, the Orange County flood Control District has offered to enter into an agreement with the City upon the following terms and conditions: 1. That Orange County Flood Control District's engineer shall prepare, or cause to be prepared, plans and specifications for said culverts and submit the same to the City Engineer for check- ing and approval. ~ 2. That upon approval of said plans and specifica- tions by the City Engineer, and when plans and specifications for that portion of Project C-3 (Anaheim-Barber City Channel is Project No. C-3 of the Engineer's Report dated March, 1955, entitled "General Plans, Specifications and Estimates of Cost of Rights of Way and Con- struction of Improvements for Drainage Facili- ties for Flood Control in Orange County, California," on file in the Office of the County Clerk of Orange County.) between Dale Street and Euclid Avenue, and that portion be- tween Euclid Avenue and Ball Road, have been approved by the City of Anaheim in accordance with the applicable provision of the Orange County Flood Control Act, the Orange County flood Control District shall promptly undertake and perform all of the work of advertising for bids and awarding a contract, all in accordance with the provisions of law governing the same. 3. That during the construction of said culverts, said Orange County Flood Control District shall furnish a resident engineer to perform the usual functions of a resident engineer; and during said construction the City may also fur- nish a resident engineer, and in such case, the -1- two resident engineers will cooperate and consult with each other, but the orders of the Orange County Flood Control District's resident engineer shall be final. 4. That, as hereinafter provided, the City shall pay to said Orange County Flood Control District, City's percentage of the cost of said culverts; said percentage of cost to be computed on the following basis: (a) The actual contract unit costs shall be used to determine the total cost for each culvert, said unit costs shall be the cost of structure excavation, compacted backfill, reinforced concrete, reinforcing steel, and crushed rock for subgrade preparation. (b) The total cost of each culvert shall be divided by the length to arrive at a per foot cost for each culvert. The per foot cost shall then be multiplied by 16 for the Euclid Avenue culvert, by 27 for the Katella Avenue culvert, and by 34 for the Cerritos Avenue culvert. (c) The City's percentage shall be the sum of the above-mentioned products, plus 5% of said sum to cover the Orange County Flood Control District's cost of design, inspection, field engineering, and final reports and acceptance. S. That upon completion of construction and filing notice of completion of same, the City of Anaheim shall pay to the Orange County Flood Control District its percentage of the cost heretofore set forth in Item 4. 6. That from and after the completion of said construction, the maintenance of said culverts shall be the sole responsibility of the Orange County Flood Control District. AND VffiEREAS, the City Council does find that the terms and conditions hereinabove set forth and as set forth in the agreement submitted to the City by said Orange County Flood Control District, are fair and reasonable; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the agreement this day submitted to the City Council by said Orange County Flood Control Dis- trict, whereby said District agrees to construct the culverts hereinabove referred to upon the terms and conditions and for the percentage of cost set forth in said agreement, and as hereinabove set forth, be and the same is hereby approved.
