RESOLUTION NO. 4591
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING A VARIANCE. (NO. 970).

WHEREAS, the Oity Planning Commission of the City of Ana-
reoeive a petition from the property owner ~~=
of certain real propert~ situate~n the City of
Oounty of Orange, State of California, desoribed as follows:
Anaheim,
Tae North 70 feet of the South 140 feet of the East
390.82 feet of the followIng described property:
BegInnIng at a poiAt on the East lIne of Section 18,
Township 4 South, Range 10 Vest, 5.B.B. & M., 50 chains

AND WHEREAS, the City Planning Oommission did hold a pub-
lio hearing at the City Hall in the City of Anaheim upon said peti-
tion on Mav l~. 1qr6 , notio$s of whioh said public
hearings were du y g ven as required by law and the provisions of
Seotion 9200.17 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection, investiga-
tion and studies made by itself and in its behalf and after due
consideration of all evidenoe and reports offered at said hearing,
did adopt its Resolution No. 266 ,recommending to the City Coun-
cil of the City of Anaheim that Variance No.~~_. be granted upon
the conditions stated in said resolution; ~
WHEREAS, the City Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applioable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vioinity and zone.
2. That suoh a variance is necessary for the pre-
servation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.

,. That the granting of such varianoe will not be
materially detrimental to the pub11c welfare or
injurious to the property or improvements in such
vioinity and zone in which the property is looated.
4. That the granting of such variance will not ad-
versely affect the oomprehensive general zoning
plan.
NOW THEREFORE, BE IT RESOLVED by the City Counoil ot the
City of Anaheim that a oonditional zoning varianoe be, and the
same is hereby granted to ALLAN L. CAMPBELL, 11611 Desmond Street,
Garde. Grove, Callteraia, to construct and operate a restaurant
and cecktail har on the property herelaabove descrihed, sahJect to
the fellowlag conditieas:

1. That the huildings be constracted in accordance
with the tentative or rough plan submitted to
tlle City COl1nc 11 and on f 11 e with the City of
ARahe ia.
2. That the owner of subject property deed to the
City of ARaaeim a strip of land 53 feet in width
from tae center line of tae street, along Brookhurst
Street for street widening purposes.
3. TAat tae owner of sUhJect property construct or
install a sidewalk en Irookhurst Street, as required
hy tfte City !agiaeer.
The City Council hereby reserves the right to revoke suoh
variance permit for good cause or failure of said owner ~A'lJ~, his
heirs, sucoessors or assigns, to comply with the Anahei~unicipal
Code and regulations and the conditions herein. Said variance is
granted for the term presoribed by the Anaheim Municipal Code unless
otherwise speoified herein.
